I live in a very rural area where everyone hunts and fishes.
Game of all sorts is common table fare.

A dog apearing like that out here would be feral or "dumped" by somebody.
It would be put down as a matter of course without the blink of an eye.
Next time it might hurt somebody-no next time.

No cruelty or abuse involved-just the way we do it.

What does a dog have to do with table fair?

Why not a pet that slipped its collar or tunneled under the fence?

It would be put down as a matter of course without the blink of an eye.

Unless you're the one being gunned down because you dared to give warning when you felt threatened.

I *was* bitten or rather nipped quite often. And what I learned is how to handle most dogs I run across, short of the actually feral or nasty ones.
If someone shot my wife's dog she'd be about as close to someone shooting her kids as it comes. I'd definitely hide our guns for a few weeks.
I don't know about where you are, but here in Ohio:

  1. I have no duty to "know dogs".
  2. I have no duty to be "nipped", bitten or anything else by a dog on MY property.

If a dog is running loose "nipping" people, it's fair game. The owner is also civilly liable.

I'm not the "Dog Whisperer". Keep your dog under your control or risk having it shot.
 
How dare you advocate personal responsibility on this forum sir.
It seems you advocate the "personal responsibility" of everybody BUT the dog owner.

Don't let your dog run free and bite people in Ohio. You won't have it for long.

If it was someones pet, and they let it run loose, they take any and all risks of what could happen to it. They also take responsibility of someone is hurt by it. For instance, my dog I let run loose, but she is wary of most people and therefore runs a negligible risk of injuring someone. In most states, a dog without a collar running loose can be taken to the pound at any time, and they MUST be considered dangerous. Even if your wife's dog is like a child, if it were to run loose without any tags AND be potentially dangerous, she must bear the risk of it being shot.
 
In my state, animals are a strict liability. The owner failed to control it. There is no 'degree' of bite that is 'ok' or 'forgivable'. My toddler does not have to soak up any degree of harm because the owner failed to control it. It doesn't matter if the toddler yanked his ears and mocked his mother, the dog is at fault, PERIOD. If the dog can be found and identified, I would insist on animal control putting it down.

Having said that, I can't imagine using deadly force in this situation. I'm not pulling out a gun and shooting a dog that is in close proximity to my toddler. And like they say, going and LOOKING for a dog that is no longer a threat to kill it is a good way to get into many different flavors of trouble.
 
W/o video of the incident we dont know what happened. To the OP at 3yo and being a boy your son needs to learn how to approach a dog and pet a dog correctly. Brownie points to anyone who can enlighten the OP on this. How many of you know how to pet a strange dog correctly?

First dog from what the OP said I dont think you can call the the dog's behavior aggressive. A video of the incident would show on the non verbal clues the dog gave before the nip. I know what a dog is going to before it does. if the dog had a tail was tail up and waving, neutral or down.

I raise sheep I have disposed of or my livestock guardian dogs have disposed of a number of feral dogs. Strays I usually coral and try to get some info off the dogs tags. I then call animal control or the owner if nearby. Some livestock guardian dogs like to roam and visit. In a rural area seeing big cream colored Newfie looking dog means someone's LGD is out visiting. Most LGDs do not bite etc.

I train high prey drive herding dogs. Dogs who would kill livestock. I take that talent and drive and turn it into a useful behavior ie a herding dog. I am also dealing with a animal that is as smart as I am and one that is intelligent enough to play games and mess with me. The same dog also has feelings and each dog I ahve ever owner is a unique dog. I have lead the dog jsut like I did sailors and learn to push their buttons correctly. I want high prey drive because as their training progresses and I put more structure on them the prey drive keeps them coming back for more instead of saying adios and see you later hoss. actually I think my herding dogs are smarter then me I provide shelter, food, entertainment ie the oppportunity to mess with me and an outlet for their most basic instinct. I purchased the farm adn sheep so they would ahve sheep to work.

Nice to see we so many macho little boys who just want to kill somethin! Suggest you boys learn a little about dogs and dog behavior before letting your blood lust rule.
 
Ok, this one's gone far beyond the discussion of the legal aspects and is far out of scope.
