How do "face to face" gun sales work?

I live in California and have a C&R license. I want to sell my buddy in Maryland a gun. Either an SKS Yugo M59 or a K31.

Do I need to send it to a FFL1 holder or can I send it straight to him (he does not have a C&R)? Can I hand-carry it to him and do a FTF transfer? Is there a list of "regulated" firearms for Maryland?

I have always planned to send it to a FFL that will transfer to him, but if it can be done easier and is legal, I would like to save my friend the transfer fees.

The only people you can ship a non-antique firearm to anyone out of your state is an FFL licensee, or yourself.
I don't think you can carry to MD and then sell it to him, but I am not positive on that.
There is a list of regulated firearms in MD here and there are banned "assault pistols" list here (scroll down to the list), but I can tell you right now that neither the K31 nor the M59 are on either list and are not regulated or banned.

Depending on what part of Maryland you live in, if you are not allowed to transfer the long guns to him while in MD without going through an FFL, then I would be willing to bet that if you both went to a decent FFL dealer and asked him to do the transfer right there, then he would discount his transfer fee.
If he lives near Annapolis, then I suggest The Armory just outside of the city limits. He is a very fair man.

But hey, if you want to do it the cheapest way, then tell your friend to pay thrity dollars for the C&R license and send it to him in the mail. You would save money and he would have the license to boot.

Thanks for the reply. My friend lives near Hagerstown and I am not sure if he has a goof FFl near by.

I think I will talk to him tonight about getting his C&R.

Assuming you don't have a FFL, you don't report anything to anybody. You are smart to do a BOS though and definitely have the person show proof that they are a Virginia resident. As a non-licensed person, you cannot sell a firearm directly to a resident of another state. You can, however, ship the gun to a FFL in the state that the buyer resides and they can get it that way. Only a FFL has to do what you're talking about - he is required to collect a $2.00 NICS fee and send that to the State Police within 7 days.

It appears that you can hand-carry it to him in Maryland and transfer it without violating any federal laws. It also sounds like your friend could come to California and get it without violating federal law. This seems logical because your C&R license is a FEDERAL license, thus it should be valid anywhere in the US. From the atf website:

Q. Can a licensed collector sell a curio or relic shotgun or rifle to an out-of-state resident?

A. Yes, a licensed collector is specifically authorized to sell a curio or relic shotgun or rifle to a nonlicensed resident of another state so long as the purchaser meets with the licensee in person to accomplish the transfer, sale, and delivery of the rifle or shotgun. The sale, delivery, and receipt the rifle or shotgun must fully comply with the legal conditions of sale in both such states.

Of course, you'll need to check state law as well.
 
Virginia does ftf deals, except when buying from a guns store you don't have to fill out any paperwork unless you want it for your own records.

I've always (all two times that is) written up a bill of sale that recorded the names of both parties, a description of the gun, the s/n and had both parties sign it.

This way if the gun is used in a crime 20 years later and traces back to me, I have evidence that I sold it.

I've only sold to in state people who I know.
 
The business about "resident of another state" applies no matter where the transaction takes place, whether in the seller's state, the buyer's state, or in a third state.

You might try Gunrunners in Frederick, (301) 662-5912 (Tue-Fri evening, Sat all day). He does handle transfers.

Honestly, this is again a situation where he can buy a K31 and an SKS easily in MD (not regulated), so the hassle to transfer the guns might not be worth the trouble.
