Illinois FOID Problems continued...

Well I never thought that I would be applying for a foid for my 4 month old...but with the legislative problems in the great state of IL I did in order to avoid possibly waiting till shes 10. Any how anybody else in IL tried to get one for a young pup?????HOw did it result??????I've read and heard that the ISP is not issuing any under 10 years old right now, this may be a little illegal if you ask me since the law hasnt changed yet....:fire:

I do know at one time the ISP was running WAY behind on FOID applications...which in itself is illegal because they have a mandated time to turn around requests. (It's OKAY for them though, just you don't try it!) Just another way this liberal nanny state is trying to outlaw firearms and turn otherwise law abiding citizens into criminals (own a gun and have an outdated FOID = criminal). We are all subjects in IL.

State Police

Our POLICE are arbitrarily raising the minimum age to 10 years old.

I just love leaving this discretion up to the IL State (politically run) Police! :banghead: I want these people setting the laws!:eek: How long before they set a maximum age for gun ownership in IL!:mad::fire:
 
Anybody tried to get FOID for children under 10 recently? What could my next step be if and when it is denied?????:cuss:
 
Have you sent it in yet ??? If not, go ahead and send it, give them 60-90 days (the usual turnaround time) and see what happens. If they reject it, then you have actionable cause. If it's not rejected then NBD. But you have to give them a chance to screw up first, before you can go after them.
 
That just isn't true--The police don't make the laws, the IL Legislature does that------right? I'm sure I learned that in Civics class.
The law also says they are required to issue the FOID card in 30 days. For many years they routinely took much, much longer than that.

Now they have made up an arbitrary age limit that does not exist in the law.

These are the same guys who were recently sent out to hassle citizens opposed to a gun banning bill up for consideration.

I used to think pretty highly of our state police, but they are getting more and more political.

Not too long ago the head of the governor's protection team got caught taking an intern with him on an official trip, along with a lot of questionable expenses. They spent a ton of money trying to cover this up (something like $20,000 in legal fees alone), but were eventually forced to release the expense reports in question.
 
I got my FOID card over the summer and it only took about a month. I went through a gun shop to do it so maybe that helped.
 
i love how as in nics wasnt enough........ stupid card i got mine a while ago made me spend $10 on a passport photo and ended up using a old old old license photo....jerks
 
You know, I grew up in IL. Downstate, not up near the People's Republic of Chicago (strangely I love to visit there, just NEVER live there).

I weep for my state whenever I see just how messed up it has become.

And then I thank God I live in Virginia. Even the Democrats are pro-gun here (at least more so than elsewhere).
 
Scout, Yes I sent it in a few weeks back when we had this talk via pm. I cant say that I even want to go after the state, I just want things right again. I say again as if things evere were right in this state, ell at least in my lifetime...
 
Start a lawsuit for violation of your rights and for not following the law. Perhaps a class action lawsuit is in order.

The ISP are making up their own rules and violating the law by not issuing FOID cards to 10 year olds. Not to mention within so many days. Someone needs to sue for a civil rights violation.
 
Okay, then give them time. Once you get an answer we can go from there.

She hasn't committed any felonies in the last ~4 months has she ???? :D

I should be out at the club sometime this weekend (not sure when)..... If I don't see you then, then will you be at the 20 Dec meeting ??? (We have the Candidates forum that night also.)
 
it looks as if Im working the 20th,but we'll see if that hols up, I may have a Kelly(work reduction) day. I will possibly be out to break in 700 police .308 tommrrow mid day 11-12ish...
 
I had an experience trying to buy ammo in Berry IL. The check out girl asked for a FOID card. I told her I didn't know what that was so I probably didn't have one. She said I had to have one to buy ammo. I told her that I knew the law and she had to sell me the ammo under the terms and conditions of my home state. she says what's that? "Here's money gimme the ammo". She rang it up and I left with the ammo.
 
Two years, two separate applications, two photos, and two $5 checks mailed and we still have not had a response or a FOID issued for my significant other.

Apparently the state of IL doesn't think a young single woman living on her own should have the right to own or legally possess a firearm. This state is full of ****.
 
Gary Frost: She did not have to sell you the ammo, however it was legal for her to sell you ammo without an FOID as your not a state resident. Just a little semantics thing.

Either way we need to get the FOID law reappealed. And we also need a CCW law.

Time to kick it to a lawyer. Unless she has an arrest record, bet she'll have her FOID inside of 2 months. Had a friend who went through the same problem -- and the lawyer's letter fixed it.

Damn shame the State feels that personal defense is a state granted right rather than a God Given Right.

I have never heard of them denying an application and not stating why. Is it possible she is not legally eligible to own firearms? She can call and ask.

They won't issue if she does not have an IL DL or ID.

I might buy that they lost one app, but two seems unlikely.
 
Pick up the phone and become somebody's nagging pain.
A few years ago I had a problem getting a timely renewal of my IL FOID. I have a fairly common name and the initial computer check showed 49 felons with same/similar name which then required human review to compare addresses, race, birthdate, etc to verify that I was who I said I was. I had applied for the renewal with plenty of time but I called ISP firearm division when I was a couple weeks from the date on my card. I was told that they had a backlog and just to wait a little longer. The day before my card expired I had the day off and still no card. I called again and was told just to keep my firearms locked up at home and unloaded and I would be OK (even though I could have been charged with unlawful possession!) This really P'd me off so I spent an afternoon calling my reps and state senator's offices, the governor's office, the DNR and ISP, and the ISRA. I wound up talking to the director of the ISP FOID-whatever division and had a spirited but polite debate with him for 15 minutes. Got assurances that my app was being fast-tracked and had my card in 4 days.
Seriously, if you are not getting the service from these public servants get on the phone and start bichin and keep bichin until they do something! It does no good to whine here does it?
Oh, and while you got them on the phone... Let them know its time to VOID the FOID in Illinois!
 
The law is very clear on this. The ISP has only 30 days to either issue or not. The law is also very clear that the onus is on them to prove you are not eligible, not on you to prove you are.

But since there is no penalty in the law for them failing to abide by the law, they get away with this kind of nonsense.

They eventually get around to issuing the cards, but it can be aggravating when they knowingly violate the law, and just don't care.
 
ilbob, you are correct. The ISP does not care about the law, the level of customer satisfaction, or our inconvenience. However, in my limited experience, they do seem to take notice when they recieve calls from state senators, representatives, and assistants to the governor- especially several in the same day. A polite but firm position backed up with reasoned arguments and ACTION can cause some movement in the beauraucratic machine. If people are willing to wait months or longer and accept that level of service, then they will get what they deserve- ie more of the same. If folks find this situation unnacceptable- they should act like it and start pushing some buttons.
It is the squeekee wheel that gets the grease and my wife says I can squeek louder than anybody.
