I wonder if I could find myself in trouble with the law if I sent in a FOID application for my dog, along with a photo of him. I would love to see the legislature debating a change in the law to specify that only humans can have a FOID card.

Going back and checking the my PM's, the OP would have sent the FOID app for his daughter in approx ~5-6 Nov. Give them thirty days (I'm not a Nazi, so figure 2-3 days in the mail, losing 2-3 processing days because of the T-Day holiday, .gov employees are people with families also, and another 2-3 days for return mail). If you haven't seen/heard anything by say 15 Dec then I would call the ISP and ask for it's status.

Once you have the status then you/we can go from there. Until then, "tis all sound and fury signifying nothing."

Your dog would need to have been issued either an IL DL or ID card first.

People around here used to have a lot of fun with it. They would wear obvious disguises, dark glasses, clown hats, etc.
 
AFAIK, the ISRA sent a note out that the ISP had quietly stopped issuing FOID to those under 10 years until further notice back in June when Mr. funwriter whatshisname wrote his great expose' about getting a FOID for his baby.

SPRINGFIELD, IL - - The following was released today by the Illinois State Rifle Association (ISRA):

Controversy has been raging for several weeks over a proposal promulgated by the Illinois State Police that would set the minimum age of issuance for Illinois Firearm Owner Identification (FOID) cards at 10 years of age.

Outdoor sporting organizations, including the ISRA, oppose the adoption of the provision as it would have an adverse impact on gun safety training and youth shooting programs. On the other hand, gun control groups support the new restriction and see it as yet another means of discouraging participation in the shooting sports.

Approval or denial of the proposed regulation is the responsibility of the Joint Committee on Administrative Rules (JCAR). As of the issuance of this press release, only a few days remain in the period during which the public may submit comments to JCAR regarding the proposal. Once the comment period expires, JCAR will consider all comments and will issue a ruling on the proposed age limit some time in the next several months.

Although adoption of such regulations is strictly within the purview of JCAR, an investigation conducted by the ISRA has revealed that Illinois State Police Director Larry Trent unilaterally established a minimum age for FOID applicants and began denying FOID cards to citizens less than 10 years of age as early as May 2007.

“Director Trent has taken it upon himself to nullify the authority of JCAR,” commented ISRA Executive Director, Richard Pearson. “Last May, he issued a declaration to the FOID division staff that directed the denial of FOID cards to applicants less than 10 years of age. Since that time, the State Police have used this bogus age limit as justification to deny over 200 applications. Of course, Trent’s edict has not stopped the State Police from cashing application fee checks.”

“The ISRA is presently consulting with its legal advisors to identify a means of relief from Trent’s illegal actions,” continued Pearson. “Without a foundation in law, Trent’s age restriction places the State Police in violation of Section 5 of the FOID act which requires that FOID cards be issued within 30 days.”

Mine came after about 7 weeks (last Monday). Now I find out that the 10yr/10 dollar FOID law went into effect on 1 Jan 08. So, I could have had dispensed with the non-sense for a few more years had I known. Maybe this will be incentive for us to leave IL by then???

BTW--has anyone heard about a final 'ruling' about the 'under 10' policy?
 
Got the letter of "Suspension"

Received the letter today from ISP Colonel Michael R. Snyders,

"The Illinois State Police wishes to acknowledg the receipt of your childs application for a firearm owners identification (FOID) card. Due to public safety concerns regarding current applicaition processes involving issuance of FOID card to infants and children we are temporarily suspending the processing of the applications for anyone under the age of ten.

A decision wheather to resune processing will be made once a thorough review of this issue has been completed. Therefore the application and fee you have submitted are being returned. You will be notified once a decision has been finalized. Please contact FOID staff at 217/782-7980 should you have any questions Thank you for your understanding in this matter"

Well ***. Whats next any body else gottern this letter for children under ten. I know IM a bit drastic by applying at 5 months but if it is cahnged she may never get a card until she's 10 or even 18. Iagree all together that the foid is bs but unfortunately my club requires anybody on the line to have a card (with gaurdian or not)...

He ought to be ashamed to write a letter like that.

But, he is also the guy in charge when a couple ISP thugs hassled a law abiding couple for faxing a legislator their objections to a gun ban bill the legislator had introduced. Any decent head of such an agency would have come down on such thugs like a ton of bricks. But most likely he ordered it in the first place. His only allegiance is likely to our latest crooked governor.

Used to be a fine agency. I think it now needs a house cleaning, but as long as we have crooks running the state it probably won't happen. They need pliant people in LE to let them slide, and in a few cases actively collude with them.

ilbob, to be fair, we don't know for sure that it happened that way. Even if the visits happened for the reasons that the detectives allegedly gave the "suspects," ("You should probably stop sending FAXes to Senator Kotowski.") it's entirely possible that the detective was expressing his personal opinion as to why he'd been sent to the home.

In other words, the ISP may have been sent by Kotowski to investigate death threats, but the officers involved may have formed their own opinions on why Kotowski really sent them . . . . and let slip their own thoughts on how he could stop the harassment.

It's even possible (but not all that likely in my opinion, yours may vary) that Kotowski got some serious threats and actually thought he'd better get all the "gun nuts" checked out. It's been very, very quiet on that front for a long time.
 
10yrs/$10 now? Glad I renewed when I did. Guess I need to start sending out more emails to those clowns. I might not be there physically, but I can sway alot of military vote by mail people and they are all gun lovers. I cant stand this crap.

please keep this thread alive and keep us updated. Also, does anybody have a way that we can spin this into activism and really get something going?

I contacted Sen. Rutherford about the under 10 year FOID and JCAR issue. Someone on his staff checked into it and this is the reply I received:

I communicated with our staff regarding your inquiry and learned the following.


ISP (Illinois State Police) filed the rule back in September of last year – First Notice would have expired at the beginning for November of last year, but they have yet to go to Second Notice on the rule, meaning bringing the rule before JCAR for its consideration and action. The agency has up to 1 year from the time a rule is first proposed to complete the rulemaking process, and the agency controls the timelines within the year.



The answer to your question, "why ISP is bypassing the General Assembly," is that this administration believes that it has the power and authority to do whatever it deems just and necessary.
