Hello, I recently obtained the application for Pistol Permit in the Liberal state of NY. While skimming the requirements I noticed something bizarre;

"You may not use relatives as character references. All references must live in Rensselaer County. References residing outside NYS are not acceptable. References must be over 5 years or more."

Here's my problem, I moved here a year ago from a neighboring county and don't know anyone that lives in this county for 5 years.

So am I screwed or what? am I supposed to ask my Neighbors to lie on paper or simply wait a few years? worried because I imagine most firearms will be illegal sooner or later with this administration.

Any help is appreciated.

You are not screwed, go to http://www.nyfirearms.com/forums/pistol-permits/

They might be able to help, usually they make some exceptions for those who moved into the area. Let us know how it all worked out....

Good Luck

I would either go speak with the judge who will sign your permit or talk to the Rensselaer county clerks office. I know several people who have received their permits through Rensselaer and they say the required personnel are friendly and helpful.

I live a few counties north of Rensselaer and my county allows for the use of the neighboring counties as well. I wouldn't get discouraged. I can guarantee you probably aren't the first.

Good luck!

That sounds like a good handle to use in an discrimination claim in court and try to get the whole dirty shebang overturned. Is there a state organization fighting that law?

I'd try just talking to the judge/issuing authorities first, to see what they say about it. Hopefully they'll be able to help.

The truth is, such restrictions are almost without a doubt unconstitutional, but you as an average joe won't get anything unless you feel like spending time/money/emotional energy (or until some of the current gun cases make it above the heads of local courts).

Call up the county clerk's office and ask for pistol permitting.
The woman there is very helpful and is a shooter herself. Ask her for clarification. Some counties ask for references "in the county" but surrounding counties are fine. My permit was transferred from another county so I didn't have to go through the normal process, otherwise I'd be able to share my experience.

In Westchester, during the NRA course required to get the permit, someone asked the co-instructor about that very situation.

"Oh yes, someone we helped asked the County that very question - they moved here recently and hadn't met enough people for all of the character references."

"You need to get out more" the County Clerk rather dryly replied.

Imagine hearing that after you've moved to NY to escape from a bad relationship, and you know your former partner is hatching plans to stalk, intimidate or harm you.

Even Ohio, when concealed carry was first signed into law, had, (IIRC) a provision for people to get an expedited carry permit if they were under some sort of threat or duress...
