The CA Felony Murder Rule is that if anybody is killed during the commision of any other felony, it is a murder charge to anybody involved in the commission of said crime. Sadly, there actually has to be death to apply.

I remember the account of a drive-by a few (well, more than a few) years back, where the fellow in the passenger seat stuck his right hand out the window, and tried to shoot over the roof. What he succeded in doing was to shoot through the roof, and capping the driver in the head. Needless to say, the resulting crash (into a fully loaded dumpster, no less) left the entire carload in need of the medical examiner's expertise. By the way, the people being shot at escaped unscathed.
