M855 victory!!!!

great. I think I hear the sound of M855 dropping in price and orders being canceled. :p

They were afraid that their power and/or their existence would be challenged. Best believe if the libs had a majority in congress, this would not have happened. Either way, good news, for now... like TomJ said.

"They would not seek to issue final guidelines at this time?" What kind of political doubletalk is that? Is this really a clear victory?

ATF Press Release dated March 10, 2015

"Notice to those Commenting on the Armor Piercing Ammunition Exemption Framework

Thank you for your interest in ATF's proposed framework for determining whether certain projectiles are “primarily intended for sporting purposes” within the meaning of 18 U.S.C. 921(a)(17)(C). The informal comment period will close on Monday, March 16, 2015. ATF has already received more than 80,000 comments, which will be made publicly available as soon as practicable.

Although ATF endeavored to create a proposal that reflected a good faith interpretation of the law and balanced the interests of law enforcement, industry, and sportsmen, the vast majority of the comments received to date are critical of the framework, and include issues that deserve further study. Accordingly, ATF will not at this time seek to issue a final framework. After the close of the comment period, ATF will process the comments received, further evaluate the issues raised therein, and provide additional open and transparent process (for example, through additional proposals and opportunities for comment) before proceeding with any framework. "

The limbo lasted long enough to dry up about all civilian M855 supply for the forseeable future and just the threat of a future ban will keep prices and demand high.

We all know how these deals work. It's like rats once the lights go on.... ATF got a little too much attention on this and so now they will hide what they are wanting to do and wait until its dark enough to proceed again.

We have won nothing as long as Congress continues to delegate it's authority to regulate firearms related activities to the same agency that is charged with the enforcement of those regulations.

They are saying that they will not issue final guidelines 'at this time'.

Instead...

...they will wait until after the comment period has concluded, and then proceed with issuing the final framework.

So... uh... how is that any different than where we were yesterday or last week? How is this a reversal? I didn't expect them to present their conclusions last week or even this week. I was expecting them to lay it out after the comment period ended, and that's basically what they just stated they will do.

All good franchises leave the door open for a sequel . . .

I'm inclined to think the verbiage is their fig leaf showing they were not defeated, just responsive to all the comments they received, but I also expect this issue will pop back up if we have a mass shooting or some other media spectacle where 855 is found to be involved.

Good stuff!!

The numbed nihilists of negativity should reflect long and hard at what happened when over 80K people took the time to voice their opinion. Just imagine if 800K had done so...

More detailed info at the hill

"The Obama administration is pulling back a controversial proposal to ban a form of armor-piercing ammunition commonly used in AR-15 hunting rifles.

The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) said it will not seek to issue a final framework for the rule “at this time” after receiving more than 80,000 comments on the proposal, the “vast majority” of which were negative.

"You spoke, we listened," the ATF tweeted."

and

"“Under no circumstances should ATF adopt a standard that will ban ammunition that is overwhelmingly used by law-abiding Americans for legitimate purposes,” the House lawmakers wrote."

one part of me is overjoyed. One small part is saddened.

I knew it would never be banned, as I had a very healthy supply of the stuff. With the divine intervention that oft seems to keep my bank account preternaturally empty - the possibility that I was sitting on a significant ready source of income was too much for fate to contend with - and the universe once again stepped in to remedy the situation lol.

Not to be a killjoy, but let us look at this as a stay of execution.

You spoke, we listened. @ATFHQ plans more study on the proposed AP Ammo exemption framework. See more http://ow.ly/Ka7iQ

The pessimist in me says this is their version of "we will try to ban it again through some other loophole." In addition, I highly doubt they cancelled this ban because of 80,000 public comments and more because of half the House of Representatives jumping on the ATF.

Waiting for Trent

Waiting for user Trent to chime in. Because what he said is EXACTLY what happened. The ATF hasn't thrown it out completely. They are waiting until they can hear everyone's commentary before taking any action. Still, the delay is indeed a victory.

I think I might be confused, but I don't read this to say anything other than "not right now".

"The ATF said in a statement on Tuesday it would not seek to issue final guidelines "at this time." The agency said it will instead wait until Americans have finished commenting on the federal regulations and evaluate their comments and suggestions before "proceeding with any framework."

So they are going to wait until after the comment period is over before they make their play. Thats all I see. Maybe I'm just pessimistic.

Victory, short-term, would be the ATF issuing a statement that M855/SS109 is _not_ armor piercing according to the legal definition, therefore not needing an exemption. As it sits now, M855 still sits in "exemption limbo."

With their own wording, I would say that it does mean what it says. The proposal has been shelved, and that a future proposal will be the start of a new 30 day comment period.

"...at this time..." Means they will ban the ammo when the political climate(meaning Congress isn't held by King Obama's Loyal Opposition) changes in their favour. Suspect 'stay of execution' is a good term.
Ya'll need to get to your elected representatives and tell 'em to stop unelected civil servants being allowed to make law by regulation. Appreciate it if you could get 'em to stop the exportation of said practices too.

If anything, this is an attempt to quell the controversy that has erupted. It may dissuade people from continuing to send their comments in to the ATF, thinking this is "over."

Not much has changed except they announced they're not doing anything right now. They're required to accept comments and cannot rule until those comments are received, anyways. If I remember right.

This is a PR stunt, and it's in everyone's best interest to keep the heat on the ATF for this nonsense.

I am proud to see my representative's signature on the letter from the House to the ATF. 7 Democrats even signed it. Awesome.

But, this isn't over.
