Do we have a summary of the changes?
I have:
- all guns limited to 7 rounds
- statewide re-registration of all handguns and grandfathered in assault weapons
- mental health professionals to report dangerous patients to county mental health officers for potential action
- provisions to suspend or revoke licenses for people found to pose a danger to themselves or others.
- monitoring of ammunition purchases on line and over the internet
Sec 17: All private sales go through a FFL, FFLs are limited to charging $10 for the transfer. Good luck with finding a FFL to take up their time for $10.
Sec 20: MDs, RNs, psychologists and clinical social workers can report anybody to the state for any reason and they lose their handgun/assault rifle license. The health care professional can not be held criminally or civilly liable, and you have no defined means of finding out who reported you. As far as I can see, there is no way for a person that has a license revoked to find out how they were reported, and no way to get your license back since you do not know why you were referred. The nurse that takes your blood pressure when you visit the MD can now have your license revoked. Lesson - all firearm owners in NY must do their best to stay far away from medical professionals.
Sec 37: Basically is the old 94 AWB definition, but only requires one evil feature. Includes thumbhole stocks and muzzle comps and brakes now as well. Pump, lever and bolt actions are exempt, and it is kind of unknown where semi autos without a detachable mag (like SKS) fall.
Sec 38: Mags over 7 rounds are banned, except for mags that are 10 rounds or less and in posession before the law passed. Relic devices that are 50 years old and specific to 50 year old guns are allowed, but need to be registered. A Garand may be in my future.
Sec 41-a: Knowingly failing to register is a class E felony.
Sec 41-b: 10 round mags are OK, but only for the person that has them when the law kicks in (60 days). We have 60 days to buy all the 10 round mags we can ever use.
Sec 46-a: Mags over 10 rounds are a class A misdemeanor, even if you have legal pre-bans today. If you posses a 10 round mag, you can not
load it with more than 7 rounds (you could not make this stuff up). In your home, it is a violation, if you have a 10 round mag with more than 7 rounds loaded elsewhere, a class B misdemeanor.
Sec 48: Registration requirement, and it mixes up the "assault" registration which goes to the state police, and the handgun registration which goes to the county license agent (typically a judge).
Sec 50: Sellers of ammo that are not FFLs already must register with the state police. Ammo sellers must keep a bound book similar to FFLs and record the date, name, age, address and
occupation of every seller and buyer. All ammo shipped in from out of state must go through a FFL or ammo seller.
Sec 51: All theft of guns or
ammo must be reported to police within 24 hours of discovery, failure to report is a class A misdemeanor.
