I have two questions regarding NFA regulated weapons and accecories.

Can you buy a registered M-16 lower reciever only without purchasing the entire weapon (cheaper?) so that you could change it out when you wanted?

What exactly constitutes a "silencer or supressor", I have a friend that has a .22 rifle that has a threaded barrel and he has a 10" long X 1.5" aluminum tube on it that has a .25" hole in the end of it. It reduces the report of sub sonic long rifles to the level of CB caps, he says this is legal because it has no baffles or internal structure, is he correct? :confused:

Yes, you can purchase just the lower. Once you have a registered lower you can switch the upper out at your leisure.

A silencer is anything that lowers the report of the firearm, even if only by one decibel.

18 U.S.C. 921(a)(24):
(24) The terms "firearm silencer" and "firearm muffler" mean any
device for silencing, muffling, or diminishing the report of a
portable firearm, including any combination of parts, designed or
redesigned, and intended for use in assembling or fabricating a
firearm silencer or firearm muffler, and any part intended only for
use in such assembly or fabrication.

Your friend is committing a federal felony, and one with steep punishments at that.

I agree with waterhouse. Your friend is a few cans short of a six-pack or in denial. He needs to cut up that can as soon as possible to avoid criminal charges. If he lives in one of the 38 states that allow unlicensed civilians to own silencers, then he should just submit the ATF form 1 and pay the $200 tax to make a legal can. The only devices that reduce muzzle noise and do not require ATF approval/$200 tax are the extension tubes that attach to shotgun barrels.

Have you actually seen the internals of his silencer? While an empty tube with an end cap can reduce noise a little bit, anyone who thinks that it works well either has hearing loss or has never heard a real silencer with proper baffles inside. He is risking his freedom for a very mediocre silencer.

You aren't going to find many registered M-16 lowers floating around "loose." Almost all of them will be assembled into rifles and the seller's aren't going to want to part them out to sell just the registered receiver.

Remember, at about $15,000 for a registered M-16, you aren't really going to save anything by just buying the receiver, even if you could find one. The high cost is because of the scarce registered receiver, not the other parts.
 
On the other hand he could be setting himself up as an ideal test case for the 10th amendment. Theoretically the Feds have no power to impose a tax on something you fashioned yourself and have not traded across state lines. Of course, it'll cost him a couple million dollars to argue it in court.
