Over 127 sheriffs (including 2 in NY) pledge Obama gun legislation will not be enforced - http://www.examiner.com/article/127...a-gun-laws-specter-of-door-to-door-gun-search
Thus, as popular support for new gun laws gradually cools with the passage of time, and reason takes the place of "knee jerk gun control," gun rights activists may discover that the President's gun control proposals ultimately have no teeth.

Linn County Sheriff Tim Mueller commented below the article that lists him saying that he did not state that and wonders how his name got on the list. Makes me wonder about the validity of that list. I'd love for it to be true, but I have trouble accepting the article when one has already publicly stated he is not part of it.

That's fantastic! We need to stay united and keep up the pressure! As New Hampshire's motto is, 'Live Free or Die'.

Thank you bds for finding and publishing the list. Most ashamedly I see there's not one TN listed. Makes me feel like OK is more my home..... never should'a left!

the sworn oat of every sherriff is to uphold the constitucion ever sherrif should be on that list unless they dont want to do their job

Tim Mueller had a letter of no compliance that he wrote posted on his own sheriff's facebook page.

Every Police Chief Every Sheriff every Law Administrator in every County in the Country Should be put too task and Asked the QUESTION< What Will "YOU" Do?>

So bitterly disappointed that North Carolina has no representation on that list.

Embarrassed.

Ashamed.

I wonder what the (awesome) NY sheriffs on that list will do about complying with the new AWB/magazine restrictions?

While at the same time, our sheriff (Elbert County, CO) did write a letter affirming that he won't let the federal government trample our rights, and he is not on the list (yet).

From the Examiner article:

"Public safety professionals serving in the executive branch do not have the constitutional authority, responsibility, and in most cases, the credentials to determine the constitutionality of any issue. Law enforcement officials should leave it to the courts to decide whether a law is constitutional or not."
(Arapahoe County Sheriff Grayson Robinson)

That troubles me, because it seems to be the attitude of so many politicians who figure they can pass a law and leave it up to someone else to challenge it to determine "constitutionality," when the document, and especially the Bill Of Rights, was written in language understandable to the layman.

As they say, what's so hard to understand about "shall not be infringed" and "the people?"

What's so hard to understand about why those ten Amendments were affixed to the Constitution?

Well, it was in order to prevent misconstruction or abuse of the Federal Government's powers.

That's why.

NYS Erie co too

The Sheriff of Erie County in NEW YORK STATE [ Tim Howard ] has stood tall and spoken out against this passage of STUPID laws that accomplish NOTHING at all.

Feel good / touchy feely spouting of a hot pile of Poo does NOTHING to make the citizen safer and NOTHING to stop the lawbreaker.

He said as much and I was THRILLED to hear him.

Remember that Arapco is a blue county, despite having a large rural, gun owning population on the Eastern side. The City of Aurora gives Arapco it's mandates, much like Denver and a couple other cities tarnish the state as a whole.

Legislators should be required to read the federalist papers and pass a test on the founders intent.

Last I checked sheriff's enforced state law not federal. These sheriff's couldn't enforce a federal weapons ban even if they wanted to.

These sheriffs are not talking about not enforcing a ban; They're saying they won't allow it to be enforced. Some have threatened to arrest federal agents attempting to enforce unconstitutional laws, and some lawmakers have even proposed legislation that would make it a felony to attempt to enforce such laws.

Which in itself is unconstitutional. It is well established that State cannot nullify federal law, and that when in conflict, federal law prevails.

That said, there is a proposal in New Hampshire to make it a felony to attempt to enforce federal law against arms and ammunition manufactured and sold within the state of New Hampshire. The theory being that since they are not involved in interstate commerce, Congress has no authority.

If this passes, it will be interesting to watch as it certainly has SCOTUS written all over it. Gutting the commerce clause would be a major victory.
