Now over 127 sheriffs won't enforce Obama's gun control laws

Only a few from Texas so far. I can see Harris County with Sheriff Garcia will not join in.

Which in itself is unconstitutional. It is well established that State cannot nullify federal law, and that when in conflict, federal law prevails.

If the federal law is unconstitutional, then it can't be enforced anyway. These state laws making enforcement of unconstitutional laws a crime give local law enforcement the tools to combat it, rather than just play Switzerland while citizens and federal agents duke it out.

As well, states certainly can and do enact laws that conflict with federal law, and there's really not much fed gov can do about it if the issue remains intrastate.
 
Whatever law Congress enacts and the President signs is Constitutional until SCOTUS rules otherwise. Under the Constitution, the President is the chief magistrate and it is his duty to determine constitutionality before signing. This is the way it was understood until John Marshall established SCOTUS as the final arbiter. So any law is considered constitutional and enforceable until a court with jurisdiction says otherwise.

Federal do not normally reach inside the state. but there are exceptions. See Articles IV, V, VI and the 14th Amendment, for examples. And Congress can be very creative in applying the Commerce clause.

I'll point out that most TX sheriffs have not said much because it's a moot point: our AG Abbott and members of the TX legislature will have their hides on the side of the barn if they try to enforce a new AWB.

Letter to the Citizenry:

Citizens of Franklin County North Carolina,

As most of you are aware I attended a meeting at Fargo’s Restaurant in Zebulon some weeks back. The purpose of the meeting was simple, to provide clarification to the citizenry as to where your Sheriffs stand with regards to your 2nd Amendment Rights to Keep and Bear Arms. Particular interest was given to the possibility of any new Federal Laws and/or restrictions and how each Sheriff would react should such measures be taken. Since that community meeting I have received countless emails and letters from concerned citizens within Franklin County. In response to these concerns please allow me, as the Sheriff of Franklin County, to make the following declarations.

As the Sheriff of Franklin County North Carolina I have sworn an oath, as have the men and women who serve under me, to "Support and maintain the Constitution and laws of the United States, and the Constitution and laws of North Carolina not inconsistent therewith". When I swore to this oath it was not intended on my part to be merely ceremonious in nature. Those words have meaning. They represent the very basis of what makes our society different from so many others worldwide. We have established a form of Government which derives its powers from the governed, as is clearly stated in our Constitution. Our founding fathers recognized that each of us is born equally into this world with certain rights. These rights were put to paper in clear and concise wording for all to understand, even future generations.

The 2nd Amendment states “A well-regulated Militia, being necessary to the security of a Free State, the right of the people to keep and bear Arms, shall not be infringed.” Our founding father’s words still hold true today. However there are some who would seek to “adjust” the meaning of this amendment and its purpose. The 2nd Amendment was not intended to secure the citizenry the right to hunt wild game; it was intended to assure the continuation of a Free State. Having that in mind I respectfully make the following statement.

“As the Sheriff of Franklin County North Carolina I, Jerry W Jones, will not participate in, nor enforce, any Unconstitutional Edicts, Orders or Laws handed down by any Government Body. As the highest ranking law enforcement officer within my jurisdiction I feel as though it is my duty to make this statement clear. No Law Abiding Citizen of Franklin County shall have their Constitutional Rights infringed upon. I have sworn an oath attesting to this statement and it will be honored at all times. I thank each and every one of you for your time and continued support of the Office of Sheriff.”

This post may be deleted, but it's time we have a passionate discussion about the future of gun rights. We can think of other countries where this has happened, and yet we can't discuss it on forums?

I'm not talking about a physical confrontation, but a line drawn in the sand..and stand firm.

Yes I guess it may come down to violating the law...but when does the law become valid when rights are trampled?

I myself being a LEO have told friends, don't register anything.

The rumblings I'm getting from friends in ATF & DHS have come to pass.

The Gov. is trying to get AR's and the like under NFA rules, and at least want them all registered. They don't know where they all are at as of now, but they will if folks register them. If confiscation follows, they will know where they are if they don't get turned in.

I have told my Chief and those around I will not enforce any new laws, unless the firearm is used in the commission of a crime...then I will add on the new enforcement guidelines.

There are a lot of LEO's that have had it with those so called upper echelon types who stand in the media spotlight claiming to represent LEO's across the nation, when they do not have even the least little clue of what we think/feel.

It's time we stand up all together and say a very loud "NO!".
 
I wrote an email to our new county sheriff, to ask where he stood on the 2nd, and other issues. He is an CHCL instructor, family-oriented, and from what I've seen on TV and heard, a stand-up lawman.

I'll wait for a bit on a reply, he must be knee-deep in getting the department on the same page, so I'm sure his time is very limited.
 
Oconee County, Cherokee County, Gilmer County, and Paulding County, Ga are saying shove it. Frankly I am trying, and hoping to encourage Millsap and Warren from Bartow and Cobb County (home of Kennesaw, Ga fyi) to get on board the bus here. That would be the entire NW suburbs of the Atlanta area backed up by the entire NW and NE parts of Georgia. So a good 5 to 8 million people saying no way!

And this isn't even the two or three million on Middle and South Georgia. Few more Sheriffs and you got a good 8 to 10 million people represented in this fight just from one state.

Well okay Fulton and DeKalb and a few middle Georgia places may be tough. But 7 million or more ain't bad right? If they step up for the people that voted them all in at least.

I suspect many lawmen and women cannot speak-up because of obvious consequences. I know a lot of LEOs who certainly speak off the record, because we are acquaintances, but would in no way jeopardize their careers by any public statements, and I don't blame them!

They are charged with scooping-up the detritus, have to keep it clean on the job or off, and are always on guard about saying the wrong thing coming back to haunt them (OK, not all of them).

I admire those who are laying it all out there, for all to see. To me that is the ultimate application of civil disobedience, to protest these insane bills at the national, state, or county levels. Kudos, hats off!
 
Naturally, none are from Illinois.

We just lost an ally late last year. The local sheriff was an active participant in promoting CC in Illinois. He had participated in at least one town hall meeting arranged by the Illinois State Rifle Assoc. (ISRA.org). He passed away less than 2 weeks after retiring but he had some health problems of late and was about 80 at the time.

Tell that to all the pot growers in Colorodo and out here on the Left Coast.....

I've got to the point where I do speak up when asked, whether in uniform or not. I figure if they ask, I'm gonna answer with what I honestly think.

Perhaps for the same reason he is not investigation 4473 violation. Biden told the NRA, they don' t have the time or manpower. But I don't really know or care so maybe you should just ask him.
 
I see no Iowa sheriffs on the list, Guess I will be moving to Missouri soon
 
N.C. Sheriffs

i have read on facebook , statements that Harnett co. and Lee co. sheriffs will stand by the constitution.THEY ARE REAL MEN !!!!!!!!!!!
 
Glad to see some NY Sherriffs on that list, but they're WAAAAYYY upstate.

As for Nevada, I'm surprised to not see more on the list, particularly Washoe, a part of the state I'm especially fond of...
 
Being that most, if not all sheriff positions are elected, a lot of those sheriff's are hesitant about letting their positions known at this time, not wanting to lose favor with other county officials.
