First, I was in fear of my life. Second, I was in imminent danger of great physical harm. Third, I was being attacked by superior forces. Fourth, I was acting in defense of another who was in imminent danger of great physical harm. I feel the headlines would be more along these lines; FIVE, SHOT AFTER AIR PISTOL ATTACK. VICTIMS OF ASSAULT "GLAD TO BE ALIVE". Cornered by five teenagers armed with high powered air pistols Josey and companion defended themselves. Police say that five teenagers are dead after attacking innocent victims in the streets. Multiple shots were fired in the running gun battle. Detective Smith says that a legal CCW holder and an unarmed companion were assaulted and shot with high powered air pistols. The victims of the air pistol attack were forced to act in self defense after attempting to run from their attackers. Detective Smith said that five air pistols were recovered at the scene. (see photo of S&W clone air pistol) The use of force by Josey is within the law according to the county prosecutor who will not pursue any charges against Josey. County Coroner Jones reports that the last airgun related death was a homicide two years ago. In that case a domestic disturbance resulted in one shot into the chest of the female victim. The husband was charged, tried and convicted of murder because of his attempt to tamper with evidence and failure to render aid. When this reporter interviewed Josey and his companion they still showed dark bruises and red welts from the attack. Josey is quoted as saying, " This wasn't Christmas, they were trying to hurt us and I believe my CCW is what saved our lives."
