He was a hero!
Take the perp's assets, sell them, garnish his pay for the rest of his miserable life after prison, and pay for mom's medical bills and therapy for the kid. And shooting lessons.
.....And shooting lessons..... Well said! Teach him better shot placement under the pre-tense of, "Dead people don't testify!"
Just curious, but wouldn't breaking into the apartment up the offense just a little? There's got to be more they can charge this guy with than a simple misdemeanor
Being the fact that her injuries were serious, I would think it would go as an Aggravated Battery. However, last Valentine's Day a BGirl had stabbed me in the side of the face with her fake nails and drew blood which ran down the left side of my head. She's only being charged with Simple Assault. Domestics are very difficult to handle by its very nature, and is really something (because of the legal difficulties in arrest and prosecution) that Public Safety/LEOs such as myself don't like dealing with.
I don't know Indiana laws, but here in PA a Misdemeanor for Assault (especially if he has any violent or drug/alcohol priors) usually ends up with one to five years, depending on the severity of the charge. Only in a Summary Offense would he only receive probation and a fine. Maximum for this offense here would be up to five years in prision (I think) and at a minimum would be probation, restitution, and Community Service. I doubt for the fact this incident made it to newspapers and television that the sentencing is going to be anything but proper and harsh.
As far as prosecution against the teenager goes, I believe highly unlikely. If a threat was perceived, then I would say verbal commands to the attacker would need to be used prior to "drawing down" on him. When the teenager arrived "at scene" the mother was already on the ground, seriously injured and continuing to be attacked. In this case it is no longer "a threat to one's life, health, or safety". It is an actual incident, and the attacker must be stopped, by means that the teenager effectively stops the attack without causing harm to himself. The young man was more than justified, considering he only wounded the attacker when he would have been justified in taking his life (In my opinion, if I'm going to shoot someone I WILL take their life). The opinion of "unarmed attacker" is an oxymoron in my beliefs here. It is conceivable that if the force of the attacker's punches and blows were drawing blood, then they could do damage to someone's internal organs.
A medal? I think that's very much in order, and should a judge and/or jury confirm the young man's actions were justified, I would like to know an address of someone in the local government there we could all send letters of recommendation to. This young man is a hero. I know where I live there have been civilian Medals of Valor issued by government officials for actions such as a child saving the life of someone by using CPR, a bystander pulling someone out of a burning vehicle, and yes, robberies being stopped by armed citizen witnesses holding the offenders at gunpoint until police arrival.
As someone else requested, please, keep us all informed of the outcome of this matter.
Sincerely,
MW
