I was driving down the street yesterday, and heard on the radio a 911 call for an older man, the man apprently was watching his next door neighbor's house while his friends were away. When he noticed to men breaking in, the man called 911 when no cops had showed up, he went out side (despite the 911 operator telling him not to) and shot the two men, as they were comming at his house.

Has anyone else heard about this? and is there any updates to this?

It's been beat to death over in Legal. When it comes down to it, he was justified in the shooting under Texas Law. Wise, or not, it was a good shoot.

IBTL.

If they were threatening an elderly man while coming at him as though to attack him, it seems to me it would be justified. Especially if he warned them to stop, which I hope he did.

Yes, this has been on the net a lot.

In Texas fatal shootings go before the Grand Jury. The Grand Jury can "No Bill" or "True Bill". "No Bill" meaning, in short, it was legally a "good shooting" or "True Bill", meaning it should go to trial.

The DA (I believe) can send the case to the Grand Jury with or without charges. Which probably has a big influence on the Jury's findings.

I heard the DA did not charge this man but I haven't heard that it's been to the Grand Jury yet.

By TX law the man did nothing illegal.
911 operators are not qualified to give legal advice and some months ago there was a 911 operator that got a lot of criticism for telling a woman not to shoot a burglar a second time.

The man saying he was going to shoot or kill the criminals, wasn't smart but people say things when they are upset.
