Lyle Denniston is the National Constitution Center’s adviser on constitutional literacy. He has reported on the Supreme Court for 55 years, currently covering it for SCOTUSblog, an online clearinghouse of information about the Supreme Court’s work.

Lyle Denniston looks at two Second Amendment cases under consideration at the Supreme Court later this month that would clarify questions posed by the National Rifle Association.

THE STATEMENT AT ISSUE:
There is “a growing line of court of appeals decisions that, while stopping short of holding that there is no Second Amendment right outside the home, consistently reach the same result by deeming any right to bear arms in public to be, at best, outside the Second Amendment’s ‘core’ and then balancing it away under an anemic form of intermediate scrutiny.”

– Charles J. Cooper, a Washington, D.C., attorney for the National Rifle Association, in a brief filed at the Supreme Court on Monday, urging the Justices to strike down a law that bans minors from carrying a handgun in public, beyond the home.

Let's be clear on this. It appears that petitions for certiorari have been filed. Those are requests that SCOTUS hear the cases. Unless/until SCOTUS agrees to hear the cases, the merits will not be considered by the Court.
 
As a retired cop I really appreciate this particular board. Nice to keep up with the ever-changing world of firearms laws, court opinions, and folks with insight who posts their comments here. Keep up the good work! I find that THR is well worth regular review if only for this particular portion of it...

Please do. I spend most of my days in the Everglades running charters but if I'm available that would be of interest. I'm up and on the road most days towing my skiff before 5am and don't get home until almost seven at night....
 
This is the wrong case to determine this issue.

We do not want the first Supreme Court case that hears the issue of what it means to "bear" arms to also have to consider whether it extends to minors.

Leave it to the NRA to muck things up.
