"If a cop wants to know the status of a gun, he has the right to run its serial number and description on the National Crime Information Computer"

He only has that "right" if he has some reasonable suspicion that it is stolen or that it has been used in a crime.

Correct. Under the Louisiana Code of Criminal Conduct Article 215.1, in order to stop and question someone an officer must reasonably believe that person has commited a crime or is in the act of committing it. He may disarm such a person, but if he does not arrest them for a crime, he is REQUIRED to return the weapon immediately.

I grew up within 115 miles of New Orleans in a small Ms town and have spent a good bit of time there. Official corruption has always been a way of life in the Big Easy, and nothing about the place surprises me. N.O. is a big mob town yet I never see reference to this fact. My advice is to avoid it.
 
I feel sorry for the people of NO, but they elected the Mayor and the city council. These people hired the police chief who sets the tone of the department. The people of NO need to help themselves first, oops, proven that won't happen. End of story.
 
On a tangent (but related), read the book "Serpico". Much better than the movie.

Another good read is "Target Blue", about the NYPD in the 1960s. It was a huge influence on me becoming a police officer in 1975 after beign discharged from the US Navy.

A large portion of "Target Blue" is devoted to the police department's corruption scandal of the 60's and the Knapp Commissioned begun to address the problem.

With me they would run into a professional Kung Fu instructor who can block a taser and cuff that sucker with his own cuffs. No mercy. What's the solution? We the people that's what. I respect good cops that are professional, and would cooperate fully. But for a bad cop they will receive instant justice. I'll end their career with three strikes. Bad cops beware.

I wish I could but Gustav knocked out my power for over a week and when it came on I still had no internet or cable. I contacted Cox and they said it would be next week at the earliest before a repair truck could get to my house. I'd read it here at work but this fraking computer has Websense software on it blocking just about everything except this forum.

would you keep a copy of that on your records and 2 would a digital copy count as I back up purchase reciepts on my laptop which I carry with me at all tiimes?

???? Dude, if you were a "professional Kung Fu instructor" you should have learned enough by now to know that your statement is ridiculous on its face. A great many of us "suckers" are accomplished martial artists also. Besides, there probably won't be just one of us. Billy Jack was a movie.

Back to subject, practices like this just burn me up. How can we expect non-LEO's to have any respect for the law when the police don't? :fire:

The problem is, it was all the ghetto trash majority in that city who did the choosing, not the law abiding people who had their stuff taken, so they are at no fault AFA im concerned. Rest of the people were the ones looting and shooting while they hunkered down just to have the Police disarm them

As soon as all other non-violent means of dealing with the "tyranny" of a corrupt government like, um, the courts fail we'll have a test. But so far there hasn't been anything since the civil war that couldn't be settled non violently.

That, is the beauty of our system. It doesn't eliminate tyranny and corruption because those things are human nature. But instead of having to resort to taking up arms and overthrowing our government, when that nature is expressed, we can vote, run for office and/or take action in a court of civil or criminal law. :)
 
So warn your friends that travel to the city to have a receipt for their guns if possible--and demand to see a supervisor if stopped by a traffic cop who tries to intimidate them into giving up your firearm.

Sorry, this just sounds so naive. Do you honestly think a receipt is going to stop an illegal seizure? Gimme a break. Do you think demanding to call a supervisor will stop an illegal seizure? Come on!

If the cop in question is going to be doing something illegal and wants to do so, he will figure out another way to take the gun and probably already has something in mind. If they are confiscating guns in that manner, then the supervisors know of the practice and are apparently supporting it because they have not put a stop to it already.

Just because officers are demanding receipts or they won't return your gun doesn't mean they will return it if you have a receipt. LOL.
 
Until the law starts putting cops behind bars, this will continue.

If these incidents can be documented, the NRA should be all over this since they were instrumental in the lawsuits after Katrina.

Come on nra members, start vocalizing to the headquarters.

We inundate politcal offices, we can also do the same to nra.

For whatever reason, I have had a very hard time getting copies of 4473's from dealers. I've had many many dealers refuse over the years.

I don't recall mentioning anything about civil war or overthrowing any government.

It seems apparent that armed resistance in the face of armed lawless thugs without badges is fine and dandy, however, those same thugs who just so happen to sport police emblems ought to be given special handling.

Katrina and NO in general is proof positive that "from my cold dead hands" is just an empty phrase.

No, it isn't fine and dandy, there is legal recourse available but it is a pain to go through.

The legal system isn't perfect and there are bad cops/D.A.s/judges etc. in it but it beats the alternative hands down every time.

Oh I dunno about that. If I was stopped in NO and a cop tried to take my gun I'd certainly let him have it. I have more. Not gonna get into a blazing gun battle at that point when I have a nice lawsuit settlement waiting on me.

There's a time and a place for the "cold dead hands" thing but this isn't it.
 
I can't say for sure what I'd do in that situation, but sitting here at my computer I imagine I would write down the serial number of the gun, the badge number of the cop, and his license plate number of the patrol car, before handing him the gun.

If he drove away with it, I would call 911 and report the gun stolen, and report that I suspect the thief was impersonating a police officer, since no law-abiding LEO would illegally take my gun... I think once "stolen gun" and "impersonating an officer" were recorded on a 911 call - along with a badge number and license plate number - you'd have their attention... if that's what you really wanted.
 
Try to find an honest cop who will help you in your fight against police corruption. But that is rather unlikely to happen since the police tend to cover for each other. even if they know their fellow officer is in the wrong they will back him up and if one officer tries to stand up for whats right and get the crooked cops removed he will most likely find himself the next target of the bad cops.

Brings up a good point. Despite what occurred/occurs in NO, police corruption across the board has gone way down since the 70's and 80's. With modern the age of instant news and internet, misconduct is taken much more serious by the authorities. It all comes down to finding the right person to complain to. In this case it would appear to be the FBI. There will always be an element of corruption with any authority but we should take advantage of modern technology and do our best to get the word out. Yell loud enough and someone important will hear.

The good lawyer assures that all appropriate legal weapons and remedies have been explored and utilized?

This is one corrupt police department in one half insane city anyway. You think it's worth a shootout with the NOPD then go ahead.

The idea that somehow it will spread like a disease through the entire country doesn't sell in this case.
