UT: Party crashed by SWAT cops

No person may host a gathering "of an actual or reasonably anticipated assembly of 250 or more people which continues or can reasonably be expected to continue for 12 or more consecutive hours" unless the host has a license, the ordinance reads.

Who's expectation takes precedence?

If the organizers say it's over at 6:30 but the crowd lingers or camps or tries to reorient till 12 Noon, are they still responsible for the crowd still being there?

Does the event end when the music stops or when the last person leaves?
 
'Round about these parts, the "event" ends when the band leaves the stage after their last standing ovation.

Beerslurpy, you obviously posted without reading the previous posts so I'll fill you in on a little fact. This wasn't a public gathering or assembly, per se. It was a business venture requiring purchased tickets for attendence. As such, it becomes subject to county business laws.

1. A county law was broken regarding business permits.

2. Widespread illegal drug use was observed (even before the law enforcement broke things up).

This had nothing to do with peaceable assembly.

Either of the above mentioned reasons are legitimate for ending the drug party.
 
I want to see the case for that as well. I think that you might be able to articulate it, provided you have enough evidence of similar events being "planned" for 9 hours but going for 12+ (assuming the burden of proof is preponderance of the evidence...I don't think you'll even get close if it is proof beyond a reasonable doubt), but I agree that they really undermine their case if the rave was only scheduled for 9 hours.

you know this is an interesting area here= i have been to a BUNCH of these parites, and it can go either way= one thing is this- if the organizers shut off the music, and tell everyone to go home, they generally will == but organizers dont always make this an issue.

if it matters, they usually do.

we have one spot on the beach here where around 9 am , a horse/tourist group passes thru- so we always make sure we clean up by then.

guilty until proven innocent or what here?
sure looks like the cops decided guilt was emminent, so it was ok to go in.

yeah the buringman thing-I was there last year....every "raver" I met was voting for kerry...they may know how to dance and twirl their hands around but they have zero debate skills and never paid attention during what little history they learned in school. the BM thing is weird- the people who work in Gerlach year round to put on the event are all gun nuts and have ccw's the people from who attend (for big bucks) are afraid of guns, these people are so dumb (BM attendees) they make a regular dumb person (like myself) seem like a PHD!
Anyway BM is heavily patrolled by all kinds of local and federal police--if you dispense drugs in the open you will be busted, A guy offered me some mints (lifesavers) from a baggie (keeps the dust out) and we were surrounded by the cops in seconds.
after they established it was candy we got into a conversation about .40 ballistics versus .357sig (well me and the cops,the ravers left)
The cops really seem to enjoy patrolling burningman ,plenty of naked gals (and guys,cops can be gay can't they) to ogle
