For those saying what about bore size, "like cant you tell a bb bore from as 9mm bore" Well yeah but a .22 and a bb look about the same, and .22 can kill
 
Legally But Not Truely A Weapon

Folks -

If someone threatens you with what can be determined as a deadly weapon (firearm in this discussion) by you at that time, the fact that it turns out NOT later not to be the Real McCoy does not alter the legal equation as to shoot/not shoot.

The legal climate is really defined by if you can shoot when you decide to shoot. Courts have made it clear if the it looks like a duck, it is a duck, since the goal of showing it is to make you think it is a duck.

Given that I am in Florida, I can act based what I see at the time, and unless I clearly break the rules I have no problems. Castle Doctrine and Stand Your Ground simplify things.
 
I don't know what I would have done, I would like to think that I'd respond to lethal threat the same regardless of who's hands its in... but I don't know if I could shoot a kid that young. I'm not condeming those of you who feel differently, but in my case I am unsure of my response.

If I could tell it was a toy, I'd be putting boot to a$$ untill the cops showed up.

I've seen repica guns that gave gunsmiths pause while they tried to figure out what they were. blank firing guns, pelet gun replicas of ppk's and walther p22's.

I don't think I could tell a .177 walther cps sport from a p22 if it was pointed at me.

I don't think I could tell a .22lr ppk from a .22 c02 bb pistol at a glance.

If the day comes where I have to face that decision.... I may hesitate, its probably just cultural prejeduce, but gunning down a 12 year old girl just would be hard to do emotionally.

physically it would be a 1/2 inch motion if the index finger, and on an older subject, I wouldn't have a problem. I probably would have less of a problem if it was a boy holding the gun. I understand that these aren't rational or reasoned responses to the situation... but while I would like to think that I would treat all threats equally, I think I have to be honest with where my head and heart are coming from.

It's definitly food for thought.

I understand what you are saying, but if anybody capable of physically using a weapon wants to act as an adult (though not being very adult in judgement), then the choice we have in this situation has no neat, comfortable, and clean answer.

When I put my Beretta in my waist band the first time, I knew what I was buying into. For 25 years before, I had been approached by people that wanted to know what kind of gun to buy to "scare" people. My answer always was - are you prepared to kill them with it. If they said no, then I told them NOT to get a gun.
 
Lots of options.

Lots of things to throw in a video store. If it's a kid and I think its a BB gun, I'm sure I would dial down the response. You get outside, block the door and call 911. You can start yelling that the police are nearly here and throw things. You can snatch up a full-sized cut-out of Barney and bulldoze them over. (If they shoot Barney, you've got yourself an incorrigable kid there.) Lots of options. Your gun isn't your only one. Yell that you just saw their mother coming. Or just hang tight. Lots of room to manoever in a vid store to buy time. It's not your store. You aren't a policeman. If you are armed think how much better you will come off saying to the TV that you didn't even think of drawing because you saw it was kids and the guns looked bogus.

It's a real gun and they shoot a clerk? Well, there's your revenge for those late fees.

I cannot believe you would rather fill a 4-5 year old full of lead, instead of taking the time to evaluate if the gun is a real threat! IMHO you should be relieved for your CCW before you kill innocent people.

No state issues CCW permits to 13 year olds, so don't worry.;)
