what happens to your guns when you die?

In new york state if you pass away and do not leave your guns (handguns) in your will, or have joint ownership specified and have someone else have them legally on their ccw permit guess what can and may happen? THEY GET DESTROYED!!!!! i have a friend who just retired from the county sherriff's office and he was telling me stories about the county bringing him handgun collections worth thousands of dollars to cut up and melt because the owners had passed away. imagine that..........a state taking valuable,,,,sometimes historical gun collections and cutting them up and melting them down. thats what happens (at least in new york state) if you do not have your handguns willed. the state can and will confiscate them when you "DIE". my friend told me of a widow who was so mad that her husband passed away that she turned over over 100 thousand dollars in historical handgun collectible arms to be cut up and melted. she said "i dont care how much they are worth, if they were his i dont want anyone to have them". each county here operates differently, with some leviances given depending on who your county reps are. this made me gasp when i heard this. someone could actually come and take all my guns and just cut them up and melt them?????????? IMAGINE THAT!!! with all that money she could have had 2 - 30 year old men!!!!! what a waste!!!!!!!! i would encourage all of you , no matter your age to research what would happen to your collection if you pass on. many of you have irreplacable historical pieces that can never be replaced,,,,and will those who love you care so much as you will about what happens to them?????? i say "plan ahead, it wasn't raining when noah built the arc" make the plans neccesary to ensure your guns live on past you. you dont have to be old. many people pass away before they plan too. i know what i am going to do......i'm listing in my will for my local gun dealer to sell them to who he deems too, with a 20% commisssion for him. the rest is going to my local fire department, where i am a member. many of you may think,,,"well who cares i'm dead, but what if someone takes your guns tonight?????? you treat them like they are part of you , dont you? so just plan ahead....id rather have someone years down the road enjoy what i have today, than have it be squashed out ,,,,,,,,,,,,,,,,,,never to be seen again. how many times have you collectors looked at a very old gun, wondering,,,, i wonder who held this before,,,or how did that scratch get there? was it in a scuffle or what,,,you know what im saying,,,,most of those who love guns,,,love history,,,,dont you? especially an old gun. you know what im saying

Depends on the State. In lots of cases where the State doesn't know what the decease owned, and not many people invold the hier(s) just takes the guns.

I had friends who relivtives spouses just give them the guns after said relation passed. Don't know about the legality of this in IL, but that is how it is sometimes done.

I did not know that! You would think the state would take to auctioning them off, to make a few bucks out of the recirc deal, especially with antiques or any other expensive firearm. This state's always crying broke! Just think of how much $$$ is generated in the lottery alone - still crying broke; sky rocketing taxes on everything under the sun - still crying broke; a raise in utility rates thanks to the state - still crying broke; permits for this and permits for that; permit to fish, permit to hunt, building permits - still crying broke; shaft people like me out of my STAR program, I call repeatedly and complain, they keep saying I will be reimbursed, but probably never will - still crying broke ... should I go on? Thruway tolls for the next 100 years and raise the tolls every couple years - still crying broke!

If at all possible, I wouldn't want the guns to go to the state, but it would be better for them to sell (if possible) than to have these destroyed.

:p Here in Arizona, when I die my wife can either keep 'em/give 'em away to friends/sell 'em to friends, etc.

Firearms here nothing more than any other possession.
 
The palerider makes a good point. Anyone who dies without a will runs the risk of The Nanny deciding what goes where. You will die, not today, hopefully, but there are no luggage racks on a hearse. Your stuff will go somewhere. It is a very good idea to make sure you voice your opinion while on this side of the sod.
 
What do I care if I'm dead
Wife doesn't particulary like guns, #1 son is a felon, #2 son is not interested, hopefully my dad will be dead before me.
Let the nephews that I barely know fight over them.
The one I like will get the best before that

I've already been through that, my FIL passed away over 5 years ago in Niagra Falls. He had only a colt pocket .25 but it was locally registered. After he passed I brought the pistol back to Ohio (Knowing that my MIL could not possess it under NY law.) About a month later I got a phone call that the local PD needed a copy of my local handgun registration papers. Had lotsa fun explaining that we don't need any papers here in free america. The conversation ended with the Detective in charge threating to call my local PD "just to make sure." He got really upset when I gave him the number and told him to help himself.

At this point i really wanted to tell him something else but gun owners need to present a better image than most and I kept it polite.

Watch your mouth -- too many of them have come to Texas bringing all their stupid ideas along with them!

I figure I'll will my collection to be split between TSRA and NRA if I don't sell them off piecemeal to finance my retirement.

palerider1 & Taurus66; You guys probably know where the Apple Town Gunshop in Williamson is. I used to have a camp in Wayne Co., but I haven't been out that way in a few years now. I hope the smaller shops stay in business as places like GanderMnt & Basspro are close. Anyhow I don't have a will, but as I get older getting one done makes sence. I think my kids should get the guns, I'd like to be burried with my bow & reloading equipment. ;)

wally; Sounds like you have concluded the NY members here have stupid ideas, but im sure you ment otherwise. You know you boys have had a few clunkers too, like what happened to the Oliers.
 
Even with a will, your estate goes through probate and is subject to nanny state regulations. Avoid probate entirely and set up a living trust and put everything you own in it.
 
We New Yorkers have got it grand... At least the greater Rochester region ain't so bad. Not like the 5 boroughs.

I am going to leave my guns to:
The people I Like : (no , I really do like anyone)
The people I do not like : (no , not enough guns to go around)
Sell them now so I do not have to worry about it !!!!!!!!!!!!!!

Really should have a better plan , something to think about.

Oddly enough I plan on it as soon as I can figure a way to afford it... This state S&@ks in so many ways!
