What would have happened if they hadn't stopped confiscating guns in New Orleans?

If the Mayor and Police Chief had continued their gun confiscation plan in New Orleans, how would that have been handled legally?

I am not talking about what armed citizens might have done, but what would the legal process be that would have stopped illegal confiscation?

Could the federal government step in and supercede the Mayors order?

Would it take a lawsuit filed by a citizen who had his rights violated?

Also, what do you think public opinion would have been if the policy had been continued in the name of public safety?

The usual quarters would protest. The rest of the country would go along with it because they have been conditioned to believe that the government has their best interest at heart.

The confiscations have merely been transfered to the ATF!!!

There may be snitches "informing" .gov who has guns and where they think they are!! I wonder if the homeowner and his family have been arrested?? I wonder if a proper warrant has been served??? What are the Feds doing searching private property for legally owned guns anyway??!!!

As was reported last week, in the wake of unspeakable crimes perpetrated by roving, armed gangs and individuals, authorities in New Orleans seized legal firearms from lawful residents, effectively disarming the very citizenry they are sworn to protect.

On Monday, NRA Executive Vice President Wayne LaPierre, and NRA-ILA Executive Director Chris W. Cox slammed New Orleans authorities for this incredible action.

"What we've seen in Louisiana--the breakdown of law and order in the aftermath of disaster--is exactly the kind of situation where the Second Amendment was intended to allow citizens to protect themselves, " LaPierre said. "For state, local, or federal government to disarm these good people in their own homes using the threat of imminent deadly force, is unthinkable."

"The NRA will not stand by while guns are confiscated from law-abiding people who're trying to defend themselves," Cox said. "We're exploring every legal option available to protect the rights of lawful people in New Orleans."

To that end, NRA has put professional investigators to work on the ground in New Orleans and surrounding areas. News stories and members' detailed accounts have been followed up on, but we need more information. Some of our best leads have come from rank and file law enforcement, but we need to hear from all directly affected citizens.

The legal process? Do you mean the legal system that is run by the same government that want's to disarm us? :fire:

There could be a lawsuit and/or a court order to put a stop to it. However, we have become acustomed to that being enough, it isn't.

Governmental entities have ignored the courts before. Way back in Andrew Jackson's day the Supreme Court ruled that his war on the American Indians was illegal- he ignored them and continued to forcibly relocate them. More recently there were the standoffs in the 1950s and 1960s when courts ordered southern schools and colleges desegregated and the governors refused the orders- it took the President of the USA to nationalize the National Guard and send them and the Army in to force the governors hands.

We could see the same here if NO was intent on continuing to take guns. The courts could order it to stop, but there isn't much stopping the Mayor and/or governor from ignoring it. The only recourse would be if the President was willing to order the military to force their hands, and then there would be the question of how far each side was willing to go (i.e. would the NO police and the US Army be exchanging gunfire in order to carry out their respective orders).

The ATF should have been disolved immediately after Waco. That is the most aggressive, public-be-damned organization in the government.

Just another reason why it ought to be legal to shoot any member of Banning All The Firearms Everywhere on sight.
 
For me, it looked like the mayor had joined his 'brothers' in the looting business. I would have filed a case against the officers for armed robbery, and the mayor for inciting it. Then let them prove it was legal.
