This isnt a situtation with me but rather my brother.
He just bought an expensive home that he planned on living for the next 10-15 years in. It wasnt completely finished when he bought it. He has probably 200K worth of stuff he is going to do to it which includes pool, landscaping, and a 1500 square foot shop enlargement.
The problem is that one of his neighbors lets his kids ride their motorcycles around their lot for hours upon hours per day. The lot is about 1.5 acreas. They create massive amounts of noise and dust. The city and county this is in has a noise and dust ordinance that they are violating. My brother contacted the guy to try and see if they could work out some limits on their riding as to prevent so much dust when my bro is at home. The guy basically told him to screw himself. Other neighbors have salready called the cops but nothing has stopped. The guy is an attorney in a million dollar home so it is likely that he is pretty good and will fight everything.
Now my brother can call the police and the county and have them issued tickets. He can also use me to sue them for nuisance. All of these would likely be successful. The problem is the resulting tension that would occur. My brother has a young son and this guy has 4. The last thing that he wants is to have years and year of vandelism that you can stop or prove. He doesnt want to live for years with a feud with the neighbors. He would rather sell his house and move than live in that headache. Originally I said to stay and fight but the more I think about it the more I agree.
What would you do?
(His plan right now is to call the cops and dust control to see if the guy will get pissed and move. He is also holding off on the high dollar improvements)
