My opinion.. sucks to be him. Tampering with the evidence probably didnt help things. Picking up shell casings kinda makes it seem like you're trying to cover something up. I say good initiative, bad judgement. I would have just let the drug dealer run away. It wouldnt have been a big deal in the grand scheme of things.
 
That's outrageous. These men may not have followed perfect procedure,but now they're lives are ruined for simply doing their job and doing it well.

Also, I wish that shot was about three feet higher.
 
More lives ruined and wasted in our needless and hopeless War on Drugs. Anyway, it was a bad shoot. I'm glad to see a case where the law applies equally to federal law enforcement agents.
 
This burns me up

federal prison for the next 20 years for assault with serious bodily injury, assault with a deadly weapon, discharging of a firearm in relation to a crime of violence, violating civil rights and obstruction of justice.

Violation of who's civil rights?! The illegal alien, Osbaldo Aldrete-Davila of Mexico carrying 800 pounds of marijuana?

In a move that still confuses Ramos and Compean, the U.S. government filed charges against them after giving full immunity to Aldrete-Davila and paying for his medical treatment at an El Paso hospital.

Isn't that sweet - granted full immunity. Why the government should give him another 800 pounds of weed, heck throw in 100 pounds of crack, write an official letter of apology to the crimi .. uh I mean outstanding role model of an American citizen's family back in Mexico while they're at it. Maybe they'll all get to come here on a free pass and become instant Americans like he just did, be given housing, unlimited unemployment, brand new full size extended cab trucks, hum vs, whatever. :rolleyes:

That's exactly where our system fails! When the mentality is just that: " Everyone has some civil rights, even illegal alien drug dealers", then we deserve to have a backward society turned upsidedown and inside out. IMHO, criminals fleeing from law enforcement surrender their civil rights.
 
I think they are trying to send a message to border patrol to handle the smugglers with kid gloves. I would love to be able to follow the money on that one.

I personally dont care if criminal illegals get shot. IMO it should happen way more often.

And I would differentiate this from the Diotaitou shooting in FL by pointing out that:
-he really was a dealer/smuggler. 800 lbs >>>> 1 ounce.
-the guy was resisting arrest to the point that one of the officers was bleeding
-he appeared to have a gun (this is arguably dubious, but not necessary to justify shooting him)

Yeah he shot him in the back and all that, but he had it coming. My opinion, obviously.

What's so innocent about being in possession of 800 pounds of illegal drugs and running from Border Patrol? The misconception people have about the constitution is they think it applies to everyone. The constitutional amendments Do Not apply to non-Americans. The amendments don't apply to illegal immigrant drug runners, Al Qaeda terrorists, the prisoners down in Guantanamo Bay, etc.
 
I wonder if they did a REAL investigation to see if the guy had a gun or not? How did the other border patrol agent get hurt if the guy didn't have a gun? Who fired shots before these guys did if the guy didn't have a gun? This is a sad state of affairs.

Everyone should be afforded due process under the law, IMO. I'm not comfortable with cops handing out punishment to people called "criminals". It's a slippery slope. You let them violate the rights of some people, tommorow they'll be kicking your door down and you'll be crying about JBT's this and JBT's that.
 
SS has a point. To hell with the illegal, we can't let his type erode away American rights whether it's his intent or not.
Having said that, the rest of the story isn't clear as Gregthehand mentioned.

If by that you mean that you're not comfortable with cops handing out punishment to people they believe to be criminals, I'd agree. Shame that has nothing to do with this case. Ramos was in pursuit of a fleeing felon, who (apparently, 'though the article is poorly written) had shot his partner.

Further, Kanof argued, it was a violation of Border Patrol policy for agents to pursue fleeing suspects.

This shooting isnt a case of justice denied. The little turd had more than ample opportunity to come peacefully and to cooperate with the officers. Rather than do this, he chose to enter into an affray with the arresting officer. Gunshots were fired and as the arrestee attempted to flee the scene, he was shot.

It isnt like the police just ran across town and shot some random mexican guy who was driving the same color van. It was the very same guy, fleeing away from a bleeding cop on the ground after gunshots had been fired. What would any reasonable person assume had happened? What would be the appropriate response?

The real hidden moral of this case is the same as for people who discover spotted owls on their construction site- shoot, shovel and shut up.
 
I wasn't implying LEOs should be punishing criminals. What I meant was there should be a separate due process for illegal immigrants who break the law (something similar to a military tribunal). There should be a whole lot less tax money afforded to the process of incarcerating or deporting illegals.

IMO, If they aren't American citizens, they don't deserve constitutional rights.
 
800 pounds of pot is what this guy was ferrying, and he gets more protection under our laws then do those who try and keep him and other drug smugglers out of the country. thats the way the system should work.
 
This is how we reward our law abiding citizens/LEOs. Another prime example of the 'inmates running the asylum'.

It's becoming sickening to me to see what our country is turning into.
 
Forgot to add this smuggler was picked up with another load after receiving
immunity in this case. I suppose he will be released on probation and go
back to work.:(
 
There must be another side to this story if twelve citizens found these guys guilty. In my experience, the government is more likely to defend questionable behavior by law enforcement than to prosecute it. I have no idea what the rest of the story is, but I'm not going to jump to these guy's defense.
 
The commotion and multiple calls for back up had brought seven other agents – including two supervisors – to the crossing by this time. Compean picked up his shell casings, but Ramos did not. He also did not follow agency procedure and report that he had fired his weapon.

Why in the name of God would you pick up your shell casings? Sounds like an incriminating act to me... that should have been left as evidence. I wonder if their departmental SOP states that they should immediately "sanitize" the scene of a shooting.

Let them fry. Drug dealers be damned, that was a cover-up. If it was a legit shoot, why not report it? Why clean up the evidence? Why did 12 people find it BS? Ummmm... too bad for both of them. I hope they do well as cops in prison.
