I was perusing the CMP website, and I just saw that the CMP will no longer direct ship to NY State customers; purchases MUST go through an FFL dealer. :cuss: :banghead: :eek:

I know this is perhaps a stretch, but doesn't the CMP "Charter" over-ride state law, and also isn't this sort of a double background check thing? :cuss::cuss:

One more question....Does the state of NY have a mandated background check fee? :banghead::fire:
 
Are you talking about for firearms? They wouldn't be able to directly ship it to a non FFL anyways. If you're talking about accessories then that's nuts.
 
Sorry but CMP does ship direct. The M1 I bought came direct to the house. No local FFL involved at all.

Just found this, makes sense now.

Background Checks

The CMP cannot ship a rifle until the FBI gives a "proceed" status. This law enables the CMP to ship directly to your door in most states. CPM monitors the FBI's approval system and processes the order when "proceed" status is given. Orders that remain in "open" or "delay" status for 30 days will be canceled. Orders are immediately canceled when given a "deny" status. If the order is canceled, the customer will receive information about how to appeal the FBI ruling.

Shipping

Rifles are shipped via FedEx Air. Packages must be signed for by an adult and cannot be left at the door. FedEx leaves a notice with delivery/pickup instructions if nobody is home during delivery. Order tracking numbers and instructions are sent to customers via email.

That's too bad they don't do that for NYer's now.
 
How are you able to bypass an FFL? Was it considered a private sale within state?
There is an exemption in the law for the CMP where they can ship directly to private individuals without going through an FFL for the buyer to receive it. I believe that they do a pretty thorough background check of some sort before they'll send it.

I still need to order me an M1 and find out. :)

Since you're in Utah, Matt, it shouldn't matter.

In NY, the bayonet lug on a Garand makes it illegal as per the SAFE act, IIRC.
 
New Jersey and I guess now New York residences cannot receive Garands direct from the CMP. They have to go through an FFL. NJ has been this way for a couple/few years.

I believe there are some threads on the CMP forum discussing this but short of reading the thread title, I have not read the content.

I do not think any other states have this limitation and CMP ships direct to the customer. Well, I do not know about California.
 
I have my C&R and the CMP shipped my M1 direct to my door here in CA. Starting Jan 1st 2014, state law won't allow that anymore. ALL transactions must go through an 01 FFL. I guess I will just let my 03 expire, no point if I can't use it anymore.
 
Up until now, CMP would ship M1 Garands, M1 Carbines, 1903's, 1903A3's, 1917's direct to door in NY. Got one and I like it.

M1 Garand is not an "assault weapon" in NY based on the bayonet lug; it does not have a detachable box magazine or a protruding pistol grip.

However, the transfer provisions bollixed up the delivery of these fine antique rifles. (Garand is over 50 years old.)
