Hey guys, I have question I hope you can help me with. I have a friend who is an older gentleman who is interested in selling some old surplus rifles. I just got my C&R and know I can't buy and sell as a business but I would like to help this guy out. Can I sell his guns for him and ship them through my 03 FFL as long as I don't make any money? Thanks.

You don't need an FFL to SEND firearms, only to receive them according to federal law. State/local laws/receiving ffl policy may vary.

Your C&R doesn't really come into play here.

They are *his* guns and should be in *his* possesion.

If you want to help him advertise the guns, and possibly answer questions, that should be OK.

But, I'd leave the sellers to make payment directly to him and have him ship the guns. He doesn't need any sort of FFL for that and there is no reason to get your C&R FFL involved in that. You really don't want to have to "log in" and then "log out" his guns.

Thanks, I was unaware you could ship a firearm without an FFL. I've never sold a gun before, I just buy them:D So if he ships the gun to an 03 FFL holder, what kind of documentation does he need? Does he need a copy of the buyers FFL?

The issue is that your FFL is ONLY for personal collecting of C&R, as these are not your weapons, and you would be awful close to 'business' even if only helping a friend, and you didn't say whether or not they are on the list.

Yeah, I'd stay away and recommend that he list them say, here, or on a state type listing site (the not craiglist lists) and offer advice, as for shipping, he can ship them to any FFL he likes, even through the mail if a long gun, but with pistol it might be cheaper to have a FFL 1 send it to the receiving FFL.

You doing a transfer would be bad juju, remember disposal on a C&R are only for improving the quality of your collection....
