Jonboy....I totally agree! Everyone I have ever had any dealings with at the BATFE have been nothing but helpfull. I know it sounds odd, but I appreciate them more than anything. Those inspectors are the ones helping to keep criminals from making it harder and harder everyday for law abiding citizens to legally carry and own firearms. I have only been inspected once, but when I was the inspector was incredibly understanding and by the end of the inspection we ended up talking about reloading for nearly an hour. The vast majority of these guys (and gals) do what they do because they are gun nuts themsleves. Just my two cents...
 
BATFE delieberately keeps that stuff vague. I could probably sell a bunch of guns to people I know and never have a problem. But all it would take is for ONE (1) gun I sold to turn up at the wrong place at the wrong time (use your imagination here) and they would nail me in a nanosecond if I failed to follow every bit of the law, and then they might well invent a law that I violated.

I am very careful when I sell a gun. Usually it is to someone I know, or a trade for another firearm here on this board. I also will not sell a gun to someone I even think my be of questionable background. One time when I had a Kimber PRo carry in the paper a guy showed up to buy it and made what he though was a funny joke and asked me if i had one bullet for it......I told him someone had called and was on their way over so it was already sold. As it turned out I knew the next guy who showed up to look at it and he bought it. I only have sold about ten guns in the last 15 years so I am OK. But my question was mainly to confirm what I thought so I could tell me buddy he needs to get an FFL or not do what he wants to do.
 
A guy at a gun show around here bought an AK for like $500. It was the last one at some guys table. Another gentleman REALLY wanted an AK also, but all had been sold, or he couldn't convince anyone to part with one. So this gentleman offered to buy the AK that had just been purchased off the first guy for $700. Guess what? At $200 profit in 30 minutes, the first buyer said "it's yours", and took that money and bought a Glock, and some ammo. Oh yeah, both were private sales.

In my mind, there was no "straw purchase", or any other kind of felonious act about, just capitalism in action. The OP's friend however, should get a license, or not engage in the practice( read as: business) of re-selling guns for a profit. That simple.

What if I had 400 firearms in my collection, and wanted to liquidate most of it towards whatever(yeah, I know lol). I would not need a license( atleast in my mind)to sell off half
of them, as it would be from a private collection, and not with intent to make a profit, but towards some end.

Just my opinion, but seems to follow the spirit of the law.

PS- Would selling to an FFL make my above example better? Hmmm.
Still 2 Many Choices!?
