Ive been gone from THR for awhile.
Ill Start at the begining.......

Back that the end of november, On a wedsday November 16th. I was startled and woken to the sound of a very large crash right out side my window( my bedroom window opens right into a alleyway... soo theres no room for even grass to grow) After the crash there was a scilence and then a eruption of what sounded like the LA Riots. I rolled quickly out of bed and listened. "*" you mutha "*"er and things of that was all i heard. "**** you, I'll drop you with a single shot!" I heard. At that moment I grabed my clothes, poped em On and went to leave, Grabbing my Derringer as i left, I put it In my Belt. I get to my car, and as im geting in one of the men looks at me and simply said "what?" and took a step toward me... I stood up straight and he saw the handle of the gun and stoped, he said" Thats what I thought." as I got in my car and left.

Heres where it gets bad... I took My derringer out of my belt and put it in the console, so I didnt blow my leg off, because I had no holster.

I drove off and got pulled over. My tags were Expired. That I am guitly as sin of, I know.... But What happened next is where things whent bad. The officer Asked me if i had a AK in my Car. Why? I had a AK magizine that was on my back seat. A few days previous my gun box broke and all the stuff inside fell out, magizines, cleaning stuff, etc...( NO AMMO, thats a different box) I had thought I gotten it all, but when I was looking for my Mp3 player I felt under my seat to find it and found the magizine.. I put it on my seat so I wouldnt forget, well I forgot..

He wanted to see in my trunk and so we did that whole thing, he found some mold, and a jack, and other things trunks tend to have in them. I was rather Irate with the search and how he kept asking if i had proper paper work for owning a AK-47. I kept insisting that i own a AKM sporting rifle which is a AK-47 clone that is BTAF approved and does not require paperwork in the state of ohio, and that 30 mags are legal to use with such a rifle. He then asked to look under my seat and in my cab, I was upset and told him what had happened to me and to go ahead...

Well he found the derringer and when he pulled it up out of the console i looked down at my belt and realized I had forgotten about takeing it off my belt. I was arrested for CCW(felony 4) and Improper Transport(felony 4).

My trial was orignaly dec 15th, it was then continued to jan 5th. I went to trail and after the evidence and everything was brought forward, plus all the letters that were written on my behalf ( noting that Im safe, smart and if i had a gun on me it was for damn good reason) by so many of the local deputys and other hamilton cops who i shoot with on a regular basis. The Judge called my lawyer up to the stand and asked him some questions,One of which was " so if it would have been on him or laying on the seat next to him or on his person, it would have been fine, but because he put it in a safe place and was made in-accesable for him to operate, hes of two felonys?"

The judge exonearated the CCW charge, as it was bogus. He also Droped the Improper Trasnport to a M1 Misdomeaner and i was only fined 140$. He told the arresting officer that it was redicolus that I was even in the court room for this, and told me that if Im going to have a gun for defense, have somthing bigger than a .22.

Thats why I was away from here. I personally feel horrible that I made such a mistake anyway. At the moment I left my house, i was In fear of my life and if i would have not done what i did, i feel i would be seriouly hurt, if not dead. however I should have known better that to put it IN the car, rather than leaving it on me and have been kicking my own behind since.
 
Now that's an experience!

Glad things worked out. It seems that some police are basically out to destroy society's trust in their profession. Now, if the sheeple of Amerika were permitted their God-given rights as designed into our Constitution & Bill of Rights, you NEVER would have experienced all of this. If this cop had had common sense (as the judge indicated) you would not have experienced this.

You should contact a talk show, and appear, speaking about contemporary society, violence and the need to defend one's self unanticipated. People NEED to hear about this story. What happened to you was simply unjust. God bless you, I glad all worked out well. Be healthy and continue to be wise. It seems to me that under similar circumstances, most people would have done just what you did...I think the judge agrees too.

Oh, and go get yourself a "Dirty Harry" revolver, or a James Bond pistol!!!!

first of all i am glade your OK and everything turned out for the better. i have to laff though about the judge saying to get something bigger than a 22. this coming from the judge gets me but he is right a 22 is a poor sd round btw welcome back.
 
I'm glad you're alright, and thanks for the insight of your story.

It's not clear to me from your post though, what was going on in the alley? Was it an attempt to break into your residence, or two third parties having it out? Why did you choose to vacate (exposing yourself to the danger outside) rather than hunker down in the house and call 911?
 
Me too. The first thing I would have done was get my gun, lock any unlocked doors, and called the cops.

I am very glad you are ok. It is a shame you were even fined.
 
Wow. I hear so much negative news all the time, it's very saddenning. It's good to hear that this judge applied some good old common sense. As for you, you definately need to take the judges advice and get a 357 of 45.

Holy moly, now that's a story. I'm glad to hear everything came out to a happy ending, I was getting suspenseful to read the ending! That judge gets a thumbs up from me, now thats understanding.

Stay safe. And get yourself a larger bedside gun :D

I should clairfy........ I didnt know what the heck was going on in the alley, i didnt know if they were breaking in or not, couldnt tell then, found out they didnt harm the house. The reason i couldnt call 911 was because My cell phone was not getting service, and i dont have a land line here at this house. my enitre collection of guns was at my grandfathers house as i was preping them for winter storage, and I had thought i brought the Makarov home with me, I didnt, it was still in my gun box, all i had here was my .22lr derringer and a 1908 lee enfield and some .303 that went "click" half the time rahter than fireing.( old war surlpus on vickers belts, not very good ammo.) soo it was take my chances with the .22 and get out while they were still toward teh back of the house in the ally where they most likely wouldnt know my presence, or be in my house with a lee-enfield that was a better pole arm than a gun, and a .22. theres also been arson going down around here and was worried they might attemp to burn the house down with me in it too.. that was also motivation for me to leave. The house next to me has been tagged gang terrirory since then so im also wondering what became of them?
 
Thanks for the additional info. It's a very interesting story, and there's more to be learned in the details.

Sorry to hear you had to go through a bunch of hassle.
But on the bright side, you got to deal with a judge who executed some common sense. I just hate that you had to pay ANY fine though.:(
