The LA city council banned possession of magazines of over 10 rounds to close a "loophole" they say. I think the definition of loophole is anything that's possible that certain groups don't like.

There are a few exemptions for possession listed in the article.

"Mike McLively, a staff lawyer with the Law Center to Prevent Gun Violence, said he hoped the law would have a ripple effect."
"This is the very kind of ammunition that allows more fatalities in a shorter time,”

This from a liar, excuse me, lawyer for an anti-gun group, who you think would know terminology better. Or really doesn't care about keeping facts straight if it benefits his group.
I guess magazines and ammunition can be used interchangeably in some people's worlds.

I found this paragraph to be the most interesting....so the L.A. Police get to SELL all of the magazines which get surrendered? Wow. What a racket.

I am certain the Crips, Bloods, Latin Kings and MS13 members will be lining up to turn in any hi-cap mags they may have as I am certain they would not
want to be in violation of this law.

No offense to Sniper56 but we need stop calling them high capacity. If they fit inside the normal grip without hanging out like the 33 round mags for the Austrian pistol they are standard capacity.

With that said, didn't the Isla Vista shooter use 10 round California compliant magazines?
 
In Ohio, city councils and local governments cannot superscede state law in these matters specifically because of issues like this where you can have a different set of gun regulations in each town you drive through.

Thankfully. Unfortunately for Californians, the only preemption in effect there is for licensing and registration, not ownership or use.
 
I don't think that's correct. I'm under the impression it applies to all firearms regulations.

Preemption is the second choice in the contents listing.
Wikipedia is clearly incorrect in that interpretation. Here's the link to the actual state law that they reference. http://leginfo.legislature.ca.gov/f...sion=2.&title=5.&part=1.&chapter=1.&article=4. It only preempts licensing, registration of real firearms and the manufacture, sale and possession of imitation firearms, not real ones. I'm not a lawyer and am not well versed in "legalese" but it does seem rather clear cut.

And living in the Greater Cleveland Suburbs I am darn happy about that. State laws trump any attempts by local laws to curtail my gun rights. Unfortunately California doesn't see things this way. Ohio does abide by "Home Rule" but not on matters concerning my gun rights. So far so good. It's really amazing what California gets away with when it comes to trampling down rights.

I am reminded of the idiot politician who wanted to ban all "High" capacity (standard capacity to us!) magazines because that would remove the AMMUNITION from the people. Yes, she actually thought a magazine was a ONE TIME use device! You just can't cure STUPID. :fire:

Another one wanted to ban slings ("the thing that goes up!") because, well ya know, there are just too many drive by sling whippings....... :banghead:
 
How did the whole idea/meme that a 10 rounder was a 'standard' capacity magazine get started? Is it all from the sad and damnable pontificating of Bill Ruger as interviewed by Dan Rather; "No honest man needs more than 10 rounds in any gun."?

I'd like to know how the brainiac lawyer who dreamed this up is planning to respond to challenges that this violates the 5th Ammendment which forbids taking of private property without just compensation. The fact that surrendered or confiscated mags can/will be sold to profit the city and police is ludicrous.

Stranger still is that apparently the LA council believes that the mere possession of 11 round mags by law abiding individuals will cause homicides ... so the answer is to confiscate them and then sell them to other law abiding individuals who presumably live outside LA :confused:
 
There has been a statewide ban since 1989. Cannot imagine a whole lot of those 10+ that were legally grandfathered in are still around?? Seems like grandstanding..

IIRC, the VT massacre was accomplished with 10 round mags.

It will have no effect on crime and killing but is a political statement.

On the other hand - think about all the times when a internet progun person says the average gun fight is 3 rounds, so they don't carry a spare mag. Or they prefer a pocket gun with 5 to 6 rounds. My 1911 carries 9.

Mayor Eric Garcetti says he will sign the measure and it will go into effect 30 days after that. Those who have magazines will have a 60-grace period to legally sell, surrender or take them out of the city.

Probably partially the idea. People could sell them out of state. Not that I think they should, but it'd be a legal option.
 
Being that the state already has a ban on magazines over ten rounds already, I suppose they simply wanted to beat the proverbial dead horse once again to feel like they are getting something accomplished with their taxpayer money.
 
I have firearms bought prior to the current 10 round cap ban. I can keep them, unless I live in LA. Can I drive thru LA city limits with my mag that is legal in the rest of the state?

I'll second that, some of the burbs would love to ban all sorts of things.

I don't think LA county has too many citizens to fight for the cause. Criminals are going to commit crimes, I don't think turning their baby cop killer mags into the police is high on their list of priorities.

Only law abiding citizens fearing the wrath of armed authorities are going to turn them in or destroy them.

Another succesful power grab, brought to you by the government that "exists to preserve your rights."
