I live and work in northern KY not too far south of Cincinnati. I recently posted a handgun on Armslist with some desired trade options and I received an email from a guy with an offer wherein he said "I'm in Cincinnati" and gave an Ohio phone number.
I responded by saying "I have a trade deal pending. Besides, if you live across the river that would be a felony for us to trade unless we go through a dealer."
His reply: "no problem I didn't realize a transaction between to private citizens was a crime, thank goodness your a lawyer"
I sent back "Selling a handgun across a state line without an FFL is a federal felony punishable by years in prison. It's very easy to verify this on the ATF website. I apologize if you were somehow offended by being given information that might just keep you out of prison. ATF reads the Armslist ads too, and occasionally nails people for illegal sales like the one you wanted me to do."
Part of me wishes this guy gets snagged by ATF for an illegal transaction just for being a jerk. Yes, I know that's petty. Guilty as charged. You would think the guy would want to know he was volunteering to put himself in the jackpot.
Not sure this belongs in Legal, but it is about people being (seemingly willfully) ignorant of the law. I wonder how common illegal interstate transactions are? I wonder if even a small fraction of them are ever discovered?
