Maryland Right-to-Carry Legislation to be Considered on Tuesday, January 22!

Maryland will NEVER go shall-issue with that kind of defeatism. Here's a little hint: If Maryland goes shall-issue, the entire "anti-carry firewall" that's put up right now will crack. Iowa will likely go shall-issue this year, and possibly Delaware too. Throw in a good Heller decision this year, and the fact that the states of Mass, Maryland, New Jersey, are licensed for all forms of carry states, which makes those statutes especially vulnerable to a "bear" lawsuit (Heller is a "keep" lawsuit).

Maryland is anti-gunners Minas'Tyreth and Helm's Deep all into one, and they won't have reinforcements in the form of Gandalf to rescue them (yes, injecting a little bit of LOTR here). We crack Maryland, next will be New York. Count on it.

All of the people from other states ought to be thanking their stars that there are enough dedicated RKBA activists in MD to keep the antis so busy that they don't have the time or the resources to launch serious attacks in their home states.

MD is one of the last redoubts of the modern anti-gun movement and we've successfully dealt them blow after blow over the last 5 years everytime they propose an AWB, ammo-tax, harsher registration requirements, etc ad nauseum.

So, before you start slinging mud our way because we haven't yet pulled off shall-issue CCW, look at all of the bad legislation we've fought off that would have been exported to your state. Bragging about shall issue successes in easy states where there was no serious opposition is nothing to be proud of. However, pulling it off in brutal battles (Ohio comes to mind as I recall) is something to be proud of.

I was at the hearing and Delegates were actually paying attention for a change, engaged and asking decent questions...it was a nice change....even that crusty old fart Vallerio asked decent questions and was generally polite to folks that came to Testify...at least he was awake this time....I've seen him fall asleep at hearings before.

With that said...Maryland WILL become a Shall Issue State eventually but it will only do so kicking and screaming.

The Delegates that were there took particular note that Md was one less than ~10 states where its citizens had essentially zero chance of getting a CCW and that the process was essentially descriminatory......they took particular notice when they were informed that even Assechusetts issued orders of magnitude more CCW's and also did so for non residents than Md does....
 
When will this come up again? Next year?

It's not done this year yet. We got a good hearing yesterday, better than ever, and it appears that some of the usual opponents were really listening to the testimony.
 
I don't understand why MDs motto is "The Free State". It surpresses the 2A rights of its citizens whenever it can.

No state nickname has ever been officially adopted by Maryland.
The Free State appellation only dates back to a 1923 Baltimore Sun Editorial.
Maybe things were somewhat better, in the not so free state ,back in the Roaring Twenties.

Can you move a loaded boxcar by yourself, by hand? Of course not. Nobody can do that. They can weight 100 tons or more. Your puny 180 pounds (or whatever) doesn't have a prayer of moving 100 tons - even on wheels.


Believe it or not, I have a friend whose job it was to move boxcars by hand. As he explained it, you get a big long pry bar and wedge it under a wheel of the boxcar. You get on the end of the pry bar and hang all your weight, and wait ... the boxcar will move almost imperceptibly - maybe a quarter inch. You do that again and again and each time it moves a little farther until pretty soon it's rolling along at mile or two an hour and you can't stop it. Moving boxcars by hand ... this is what we're doing in our fight for gun rights in Maryland.

MSI just started less than 2 years ago but this fight for shall-issue in Maryland has been going on for about 15 years.

Before MSI was started the situation had been much worse. The boxcar was moving the wrong direction (towards 'gun control') and had to be stopped before we could begin to go the other way. This was a tremendously difficult job and was accomplished by those who were on the scene before MSI arrived -- folks like (sorry, I'm sure to leave important ones out....) Sandy Abrams, Ray Albaugh, Dave Dimock, Steve Dirlik, Doug Gross, Ken Grubb, Charles Guggenheimer, John Josselyn, Phil Lee, Ed Patrick, Jim Purtilo, Mark Wilson and Dr. Zox; legislators like Carmen Amedori and Joe Getty (and many others); organizations like GOA and NRA.

Any new news about the upshot of the hearings, and what comes next wrt Marylanders' right to self defense?

I don't live there any more, but it's the state I was born and grew up in, and my brother lives there now. We talked yesterday about the just-happened Gun Buy-Up event which took place today (or was it yesterday?) -- I haven't been able to find any links to news stories about this latest sham. Apparently the money to buy the guns was put by a lawyer / law firm; I wonder if they're being destroyed, or "repurposed." As usual, I want to know how they organizers avoid prosecution for selling guns "no questions asked" -- anyone have the details? (If it's run by a government, there's sovereign immunity -- but if it's run by a community group, hosted by a church, paid for by a private company, why aren't conventional rules in place for the changing of hands? I am not favoring those rules, btw.)

Alas, this legislation hasn't a dog's chance of getting anywhere so long as MD remains a de facto single-party communist state.

I think Iowa has a good chance this year.

By most accounts DE is all but shall issue, even if it is an expensive and torturous path to actually getting a permit.

Most states there is no law prohibiting private purchase of firearms. Thats what the organizers are doing. they are not selling any firearms at all.

Its a little dubious in a few states where some kind of license or permit is required just to own firearms, and in a few states private party transactions are either regulated or prohibited.

In Illinois, for instance, the waiting period still applies for private party transactions. Unless the entity actually doing the buying is an FLL or a LE entity, they are breaking the law. Now it is entirely possible that for the purposes of the event the organizers have gotten an FFL or LE entity to be the official purchaser.
 
ilbob: I am not deeply aware of Maryland's laws, but I am confident they're more onerous than Pennsylvania's on this count (since i know that they're worse in most other respects): while in places like Texas and many others, private face-to-face individual sales are just fine and can be done free of State interference, here in PA even private sales (of handguns at least, I forget if the same is true of long guns) still must go through FFL approval. So (in PA, that is, not speaking for anywhere else) while it is as you say wrt *prohibition,* selling / buying a handgun at least "with no questions asked" would be breaking the law.

As always, corrections always sought! :)

as i said, it is entirely possible that for the purposes of the buyback that the actual purchaser is an FFL or LE entity. I don't believe any states have restrictions on them buying firearms (NFA items excepted).
 
I sent letters and emails to every Delegate on the Judiciary Commitee.

Not surprisingly, I have very few responses. This is the time when these people are the absolute most busy, so if anybody writes, don't be discouraged by the lack of immediate responses.

This also reinforces the fact that we should be pounding these people during the OTHER 9 months of the year when most likely they're thinking about getting re-elected. :eek:

This was run by a church in west Baltimore. On the evening news, they showed what was turned in: 2 rusted pieces of junk that nobody could recognize, some kind of pocket pistol and two flare guns. :neener:

I wanted to write you a quick note in regard to HB2.

I am a Virginia resident, 2 years ago I moved from Kingsville MD (near the Harford county line on Rt 1) to the Metro DC area. Living in a MD suburb would have been cheaper for me, but I chose to move to VA in part to give myself the freedom to defend myself. Also, when I am far less likely to shop/play/spend in MD because it would mean that I would need to be disarmed for the entire day as it is illegal in MD to simply leave the gun in the trunk while in MD. There are many places in MD I would be more apt to visit if HB 2 were to pass.

Some may dismiss me as a "gun nut" but I simply am a person who wishes to have access to use an effective tool in the event of a violent encounter.
 
O' Malley vetoed a bill from last year that would've allowed police agencies in Maryland to sell their old weapons back to manufacturers for credit towards NEW guns. Currently, police firearms can be bought by the officer it was issued to, or it has to be destroyed.

This year the legislature voted to overturn O'Malley's veto.

Oh the sweet irony of O'Malley's first veto override being a GUN BILL. :evil:
