I am in one of the last phases in the new york state pistol permit application process and I need to be interviewed by a investigator and go infront of a judge. I appiled for a full permit w/concealment. What would be good things to say during the interviews and what would be bad things to say?
 
Erie County eh? Good luck! My best advice, explain to the sheriff's deputy and judge that you are a collector of firearms and dont' want pistols to be an exception in your gathering.

You enjoy hunting with rifles and shotguns, but want to give handgun hunting a shot as well.

Then proceed to explain that you also feel you should have an unrestricted permit for concealed carry because Erie County is scarey. You like the idea of personal protection. You understand the rigors and sacrifices that go into police work. And for that reason, you realize the police can't be everywhere at once. Ergo, you want to take a proactive approach to defending both your own and your families lives. Finally, tell them that you pray each day you'll never have to use any firearm in self defense and that the good lord watches over you, however, you'd like to leave nothing to chance.

Now i'm not 100% familiar with Erie County's regulations regarding unrestricted licenses, but I expect the judge and investigator will tell you that's nice and they appreciate your concern. However they would prefer you to have a restricted license for now. After a few month, if you have a friend who is a lawyer in Erie County, have them help you draft up a letter asking the judge to lift said restrictions off of your license.

Kinda sucks having to go through this for our god given rights, eh? :(

Thankfully, i've never had that problem living in the Southern Tier. I just wrote out everything I wnated to say on my application and 3 months later a shiney new permit arrived in the mail. No restrictions in sight :)

I just wanted to let all you NY guys know I really feel for you. I keep reading about all the issues and hassles. I think it's crazy that you have to have a permit just to keep a gun in your home. Criminals don't get permits. They never have and never will. While you're waiting on your permit I guess you're kind of out of luck? I wonder how many people move up there who already own guns. How would anyone know unless you carried it out or told someone?

Only handguns require a permite. Nothing else does. Well, ya know, within reason. 99% of NFA stuff is unobtainable in this state too.

But you can buy EBR's and everything else to your hearts content all day long if you like :) I do ;)
 
Is EBR related to black powder? Alot of states don't even regulate black powder arms and even have special hunting seasons for them.
 
gotta register everything in NYC. i really think if it was put to a vote upstate and NYC would become two different states. the two areas really are night and day. go up around syracuse buffalo or albany, then go to manhatten. i really feel that its cheating people to try to represent them both with the same elected official.
 
I also live in upstate NY, and will eventually be getting a pistol permit. I'd like to know if it's better to ask for an unrestricted license right from the beginning, or just apply for an ownership permit, and then try later for unrestricted.
 
A good thing to say would be that, due to the nature of your business/employment, you routinely carry large ammounts of cash and/or negotiable monetary instruments, sometimes through bad sections of your town, and/or late at night, on the way to the bank.
 
I live outside of Rochester NY, and while there were a number of hoops to jump through, the process was mostly painless, and relatively quick. I got my unrestricted permit in a week longer than 3 months. I wasn't interviewed, and as far as I know, none of my references were contacted.

The best thing to do is to tell the truth. Don't say you have a "collection" when you only have 1 gun, don't say you carry cash for your business when you don't. Don't talk about hunting unless you really hunt.

I was also advised that I shouldn't come off as a police officer "wannabe". You are not looking to make the streets safer for everyone, or teach the bad guys a lesson. It's more that you understand how the world can be dangerous, and that you'd like to be prepared to protect youself if the need ever arose.

I was told that having mulitple reasons would be to my benefit. I had hunting, formal & informal target shooting, and personal protection.

I think if you come across as a level-headed person, who understands the responsibilities that come with carrying a firearm, you do as well as you can. It wouldn't hurt to have some plans for taking some training and have a place to practice. Joining, or planning to join, a local gun club would be a plus, and maybe thinking of competing is local matches like IDPA.

You don't want the officer to think you're just saying things to kiss up to him. So don't rehearse some speech, that you don't really believe, but you can have some prepared reasons why you should get your permit, and why it should be unrestricted.
 
I got my permit in Syracuse and while it took longer than normal ( combination of me using using the old permit forms as they were switching to the new ones, and having to find two new references) none of me references were intereviewed AFAIK, probably helped that they were all military, three Air Force NCOs and one Army LT, and all of the NCOs are also syrause police officers, so there was no concern there. I never had to go in front of a judge, but all I can say is to be honest and forthright and everything should work out.

On my application there was an extra sheet where you could write your reasons for wanting a concealed carry permit if you so choose, my reasoning was that I hunted, was an avid outdoors man and that because of the current climate of the world there may be individuals out there who may wish to do me harm to further a political agenda due to my being a member of the military with a combat position.

kind of BS, but also true at the same time.

Depends on the County

I also live out side fo Rochester and I did have to fill out the application, fingerprint and provide references. My refs were contacted and interviewed, I was also interviewed by the investigating officer and several other references that I provided over the phone including my wife were interviewed.

The investigating officer was the person that took my prints and while he was doing that he was giving me pointers on self defense shooting skills and relaying his experiences with use of deadly force in the line a duty. he had just been involved is a bank robbery shootout.(this was last year about this time)

The investigating officer did a very complete investigation. But seemed very pro about CCW in his county.

I never saw a judge, and the only reason I put on my application was that I wanted a permit for "all legal purposes under NYCRR" New York Code of Rules and Regulations. 7 Weeks later I recieved a full unrestricted Pistol Permit.

It also seemed that once my prints cleared the FBI the investigating officer got it done very quickly, he called all my references and myself in one day.

One week after that I had my permit.

NY is really bad in some counties and real close to shall issue in others, that's the worst part, just not consistent.

Just got my permit! it took 11 months but its finally here! now the question is what kind of gun do i want??? glock or smith and wesson.....any comments?
 
Welcome aboard to NYS CCW! Glad to see aniother one made it through the hoops.

If you are going for 357, I would recommend a 3" SW K-frame or a 3" SP-101.

As far as Glocks, they are good pieces and any one of them would work well.
 
thanks for the info....im extremely excited about receiving my permit!, is it true that you have to purchase a slip now to purchase a pistol?......for example i just cant walk in to a gun shop and buy a pistol, i need the slip first
 
In My County, Central, NY

We buy the handgun, take the recipt to the Sheriffs office, they fill out a request for a purchase voucher, send it to the judge, he signs it, sends it back to the Sheriff, they call me, and add it to my permit, give me the voucher, then I can pick up my new gun. Takes roughly two weeks.:banghead:

Why? :confused: It should be handled by your county sheriff (some deputy usually does the background check), and if you get the green light, your papers are moved to a judge for approval/denial. I don't understand why you would have to appear in front of a judge.

I was approved in approximately 7 months. At the 6 month mark, I called the county clerk's office to 'light fire under it' and get things moving again. The deputy investigator called 3 of my 4 references, then called me, we talked for about 5 minutes. Two or 3 weeks later in my mailbox was my permit. :)
 
i didnt have to go infront of a judge just the final permit had too, i did have to speak with an officer though and give him a few more references....but it doesnt matter anymore bc i received the permit yesterday! i think i need a pistol stub or something like that to buy a pistol though.....is that correct ?
 
Not a stub, but what I have to do might be different from what you have to do. Even the permits vary from county to county. The process for me is as follows:

1. Go to gun shop and make a purchase on the handgun of my choice.
2. Take the receipt to the county clerk's office downtown.
3. Get the serial number added to the back of the permit.
4. Go back to gun shop and show dealer it's been added to my permit.
5. Hasta la vista.
 
OK, I'm having a hard time saying this on a public forum...........

But I recently got all the forms together to get a NYS pistol permit. And they now have a "Mental Health" piece in there. Several years ago, I lost my father, was in the midst of a divorce, and because of the divorce I lost my business. So, the upshot is that I was treated, and medicated for depression.

So, any one know what the implications of that might be?

My best shootin' buddy has an extensive collection of both long guns and handguns, and will will them to me on his demise (which with his health problems may not be far off). He wants nothing to do with his family, as they are a$$holes, so he would like his collection to go to me (to eventually be passed to my kids.)

I've hesitated to try to complete the paperwork, as I expect I'll be denied, because of the treatment I received. (NOTE: I was never committed to a mental health facility, voluntarily or involuntarily, I was just treated by a "shrink".)

Anyone else been through this?

NYS issues ONLY concealed carry permits. You carry it, it must be concealed. And didn't put anything of the sort on my application.
