Question for an FFL

I ordered a pistol from a manufacturer. I sent them a copy of my FFL's license. Paid for the gun, it was shipped, arrived at my FFL's shop. I go to pick it up, fill out the paperwork, everything is peachy. I open the box to examine the pistol, it looks good etc... My FFL then begins looking through the paperwork that came with it for a copy of the manufacturers FFL. There is not one. There is manual, invoice, etc... no copy of their FFL.

My FFL advises he cannot complete the transfer to me until he receives a copy of their FFL.

I don't know what the rules are. I have absolutely know reason to believe my dealer would make it up. I have no reason to believe the mfg intentionally is trying to slow things down.

What is required? Is my FFL right? Or is that FFL copy from the mfg not required to be sent to him?

I am not really happy about this obviously, I had nice plans to shoot a new toy this weekend. I am not about to get crossways with either side yet, I know the barbara streisand that is required to get an FFL and am not going to put anyone at risk.

I would appreciate another FFL here educating me. If it isn't required and there is something I can show my FFL to put his mind at ease, I still may be able to pick it up tomorrow (Sat). If not, he is closed Monday, so its Tuesday, lather rinse repeat.

Your dealer only needs the FFL of the distributor that the gun was purchased from.

He doesn't need the manufacturers FFL ( unless you purchased directly from them ).

They are two different FFL types.
 
I purchased directly from the maker of the gun, not a distributor. Does this mean my FFL needs the copy?

All dealers need a copy of the FFL of those who send them firearms.

This can be done via fax, scans via email or an actual paper copy.

There's your problem right there. Your dealer should have sent "their" FFL license. It's the dealer's responsibility to send and receive copies of FFL's -not their customers. Your dealer needs to make arrangements when giving out copies and not let others do it for them and then try to straighten it out later. If your dealer had sent the copy to the manufacturer then they would/should know what to expect in return. Just my .02 chig
 
Why would the dealer need a copy of the manufacturer’s or the distributor’s FFL? I know that many will send them—I presume as a courtesy—but I didn’t think the law required it.

Uh, distributors and manufacturers do not need to send copies of their FFL to individual licensees.
The individual licensee has to send a copy of his license, Tax Stamp, and sometimes his local business permit to the manufacturer or distributor.
Manufacturers and distributors usually include their license number in the invoice packaging.

The Feds just need to know which distributor or manufacturer sent the firearm to the individual licensee to conduct a trace.

As correctly stated above, your dealer does not need the FFL whoever sent him the gun. The RECEIVING FFL (aka transferee) gives the SENDING FFL (aka transferor) a copy of his license. The RECEIVING FFL (aka transferee) does not need a copy of the SENDING FFL's (aka transferor) license.

Tell your FFL to read section "§ 478.94 Sales or deliveries between licensees" in his copy of the Federal Firearms Regulations.
 
If I may be so bold....as a FFL i need a copy of the FFL only if it is from a FFL.
from distributor or manufacturer...no need copy
another FFL ......need copy
from private individual...need Drivers liscence and or other picture ID...

also during my last inspection I was told I could not accept e-mailed copies...only faxed or mailed.

And current C&R....

Could you point out the regulation requiring you to have the FFL of someone sending you a firearm?


If a private person can send you a firearm from any state in the Union, why would you need a copy off an FFL's license to receive one from him?

I bet, when I see "CFR" I know it will be a nightmare.

I printed the reg, maybe that will suffice. I'm not trying to create trouble for the guy.
 
Although federal may not require the FFL recipient to obtain a copy of the FFL of the sender, state law may require the FFL recipient to obtain a copy of the FFL sender.
 
All I know is that ALL the FFL's I deal with here in Central Florida do the same thing. They will no longer accept guns from private individuals and require a FFL copy or they won't release the gun.

This is correct. Your FFL is only needlessly covering his ass, not following a Federal regulation. He is wrong to withhold your gun.
 
Nearly all sending FFL's will include a copy of the license for the receiving FFL's bound books. Pehaps its just a courtesy, but most expect it in my experience.

Verification must be established by the transferee furnishing to the transferor a certified copy of the transferee's license and by any other means the transferor deems necessary (such as the FFL eZcheck).

Having to have the senders FFL may be his store policy.


BTW, did you arrange to have your FFL do this transfer ahead of time? or just order from the factory and have it shipped so your FFL is wondering WTH!?
 
No it was all arranged ahead of time, I went to his shop to finalize my order forms, and get a copy of his FFL for the envelope placing the order.

Hopefully I can get it faxed Monday, pick it up Tuesday...
