I'm kinda surprised he gave up so easily. Seems like he was hellbent on getting himself suicided by cop. Maybe he thinks he'll get away again?

On another note, I think I disagree about the death penalty thing. Think about it. On death row, he will have a private cell and no contact with other prisoners. If he gets life w/o parole, then he will be in general population. Maybe he could resist just a little somewhere along the line, just enough to get his teeth bashed out with a 4-cell Maglite? Get my drift?

Putting him in GenPop would only be a reward for this POS. In the twisted world of criminal logic, he's a hero for offing a judge, a deputy, and court worker, and a federal agent. In GenPop he'd get treated like a king. On death row he would be by himself, with only thoughts of when his appeals will run out and the needle.
 
Doubtful he will plead insanity. It would be foolish as there was nothing in his actions to suggest that he was unaware what he was doing was wrong. In most states, to be considered legally insane you have to not be capable of knowing your actions are wrong. He acted with deliberation, and tried to avoid capture. That coupled with the previous attempts to smuggle the shanks, and threats on others, show he was not insane.
 
He probably surrendered because he ran out of bullets. How many rounds did the gun have? 12-17 rounds and we know he used at least 5 rounds in his getaway. I doubt he had time to pick up more ammo.
 
News reports said he took the first deputy's gun and belt, the second deputy's gun, and also took the customs agent's gun. I don't think it was a matter of being out of ammo. It was a matter of being surrounded by three Gwinnett Co. SWAT teams along with the FBI.
 
Hi all. I live just north of Atlanta, and I used to work downtown. Here's what I can tell you:

First off, Fulton County screwed up big time. Every other county I (and the numerous LEOs I've talked it over with the last 36 hours) know of would have required AT LEAST two officers of equal stature to escort this guy at all times. AT NO TIME should a single armed officer have been left alone with this man when unrestrained. He absolutely should have been in shackles, as he does in fact have quite a long rap-sheet. In many counties, even misdemeanor offenders are brought into court in shackles.

He outweighed Hall by 50 lbs, BTW. The poor woman was almost deliberately sent into harm's way. Thing is, it doesn't surprise me. Fulton county, and especially City of Atlanta officers have it hard. They get hand-me-down ordinance and equipment, constant derision from the liberal political system, and they can't do their job without getting slapped with lawsuit after lawsuit. They don't get treated with any sort of respect from the people they serve, and the administration gives them no support. Oh, and they do this for $35k/year.

I hope some folks in high places lose their jobs over this, but it likely won't happen. Blame will somehow be shifted to the officers themselves rather than to Nichols and the people who decided that simple security precautions were "too expensive." All day yesterday, talk radio shows had people calling in using facile arguments to say that this proves how "incompetent" the police supposedly are and how they just won't give a broth^H^H^H^civilian a break. It sickens me. Even the local paper seems to have taken a very accusatory stance against the officers, rather than the city officials, where the blame belongs.

Of course, this is Fulton county, where the last sheriff-elect was executed gangland-style by his opponent. They've decided to appoint a "task force" to investigate yesterday's incident. Anyway...

Judges and DAs can carry in court, and many do here. Unfortunately, Barnes was taken unawares (he was shot in the back of the head), so it probably wouldn't have helped. When a guy like Nichols was in the courtroom, he should have been attended by two unarmed deputies, with a third, armed deputy across the room.

Georgia DOES have a death penalty, and he's eligible for it three times over. It's a foregone conclusion for the judge and the deputy, and very likely for the court reporter. (In Georgia, if someone dies during the comission of a crime, the defendant is charged with murder, no matter how it happened) What's more, the killing of Wilhelm means he's up for the Federal death penalty as well.

My prayers go out to the officers and their families today.

BTW, Fulton's Sheriff was not killed. Dekalb County's Sheriff-elect Derwin Brown was executed in December 2000. Outgoing Sheriff Sidney Dorsey was convicted of his murder, along with various racketeering charges. 7 of the last 8 Dekalb sheriffs have been indicted for corruption charges. Fulton's last sheriiff, Jackie Barrett, has been the target of a federal corruption investigation and was forced out of office last year.
Its easy to get the two confused b/c the Atlanta city limits extends into both counties, although its primarily in Fulton.

I echo Erik F sentiments totally. I am an Atlanta resident and let me tell you, my neighbors are incensed at the politicos in charge. It is time for a regime change in Atlanta, but it aint goin to happen as the majority of people that care all live outside the city.

There's apparently some debate as to the $65,000 reward. To me it's a true no brainer. She made the call with an exact location and actually kept him there after talking him into surrendering as I understand it. Told 911 where the guns were, everything. Seems like a truly remarkable woman (sorry, person).

Is there someplace/someone we can e-mail showing our support for her??

Well, guess I did it! Not real sure how it ended up there.

Back on topic; like most here I was hoping we'd hear of his demise rather than his capture, preferrably by CCW citizen, 2nd choice by LEO, no suicide.
But all in all it appears to have turned out quite well.

I've been traveling a few days and just now read this thread, though of course I saw news stories about the incident.

The question I have is what kind of holster did the deputy have? I'd be interested to know if it was a good quality holster with some security or just a thumb break. I'm not asking to lay blame on anyone. It's something the sheriff there should think about.
 
I haven't heard the whole story yet but on Sunday FOX news said that her gun was in a lockbox. He knocked her senseless, took her keys and unlocked her gun. How true this is I don't know. Notice that although they have video of almost everything none of it has made it to the media? I understand the investigation is on but I don't think Fulton Co. is in a hurry to let us witness just how inept they are. Guvment workers ya know.
