Tax dodgers taunt police from hilltop compound

No responsibility to appeal it? No responsibility to change it by working through the political process to pressure or elect legislators to change/repeal it?

Help me here.

When those fail, the last recourse is to break them.

Vetting by the Gang of Nine doesn't make a law good or just.

I sometimes wonder if I'm the only person here who's read Henry David Thoreau's On Civil Disobedience.

If you would prefer not to pay the deficiency, then you have 90 days to file a challenge in tax court. If you challenge in tax court, then you don't have to pay the tax until a final decision is reached (which can be nice as these cases can last years; but you'll pay interest from the date of the deficiency if you lose). Once the decision of the tax court is final, it may be appealed to a circuit court of appeals under the Administrative Procedures Act (APA) just as any other administrative procedure can.

The whole purpose of tax court is for those people who want an expedited answer to their dispute with the IRS. It is difficult to combine expedited and the same process (complete with jury trial) that you would get in a federal district court.

The point is, that while there are pluses and minuses to either choice of forum, the choice is up to the taxpayer and they can have their day in court where ever they choose.

wonder

"I sometimes wonder if I'm the only person here who's read Henry David Thoreau's On Civil Disobedience."

i wonder how many know the tax he became a "hero of the revolution" for was paid by his friends to keep his tail outa jail

Don't you recall the Walden Pond Masacre? Thoreau was under sealed indictment from the AGUS for failing to support the War for Mexican Liberation and domestic terrorism and failure to pay income tax. He boarded himself up in his compound cabin with assault muskets and 10 pounds of highly explosive black gun powder.

After a 174 day stand off during which smoke signals were exchanged the US Marshalls brought in their armored wagon and a team of Oxen to assault the compound. Several casks of burning oil were launched at the compound prior to the assault. The AGUS later remarked; ''We didin't know for sure that the reinforced cellulose based compound would burn but we had to try something, the CNNs coverage was killing Pres. Polk's chance for reelection''.

Thoreau fled the flames and jumped in Walden Pond as his followers were roasted alive. More than 40 chickens, pigs and small furry animals were lost. The firemen all agreed that they were delicious.

After being tortured into confession at a secret prison Thoreau began to have ''visions'' of ghostly people approaching his cell. Including his brother who had been taken out by a CIA Bio-asassin team and Ralph Emerson who was planted by the same to get him to turn double agent...... Oh wait a second....

I think he just went to jail for not paying his taxes and still stood up for what he believed in. Lived lightly on the Earth and spread a message of freedom. I don't see the comparison.

But “Civil Disobedience” is not an essay of abstract theory. It is Thoreau’s extremely personal response to being imprisoned for breaking the law. Because he detested slavery and because tax revenues contributed to the support of it, Thoreau decided to become a tax rebel. There were no income taxes and Thoreau did not own enough land to worry about property taxes; but there was the hated poll tax — a capital tax levied equally on all adults within a community.

Thoreau declined to pay the tax and so, in July 1846, he was arrested and jailed. He was supposed to remain in jail until a fine was paid which he also declined to pay. Without his knowledge or consent, however, relatives settled the “debt” and a disgruntled Thoreau was released after only one night.

one nite in jail = hero of the revolution

Thing is, the Browns are willfully disobeying the law because it is perceived as unjust.

Odds stand right now that they may indeed be killed for it.

But keep the flagwaving "Wez needz Lawz & Orderz!!!!!!111one!!!" going. After all, why be bothered by morality when you can just substitute law for it.

I'll give the Browns credit for one thing. However misguided I think their efforts might be, they are out there trying to change things and putting in the work. They aren't sitting on the Internet complaining about how bad it is while doing nothing to correct the problem. Hopefully that is true of those of us in this thread as well.

I guess I will be maintaining that Texas residency when I move the family back there as the penalties do not apply to non-residents. The good people of the Commonwealth are going to appreciate the fairness of that one in no time.

Hmmmm... Virginia has never had a govenor impeached before I wonder....

the part

that gets me is failure to use turn signal comes under reckless driving

fortunatly i'm of the experience and belief that cops can/will do some "on the spot" adjusting in how they write tickets

What are the Browns doing to change anything? They lost their case. They rolled the dice and lost. Now they're sore losers.

Objecting to six years of being locked in a cage where murder and rape is common because you:

- harmed no one
- were denied the ability to present most of your defense before the jury
- had your tax questions answered with "enforcement actions"

... is being a "sore loser"?
No rape joke intended, I assure you.

is the ultimate win lose game

Not really, in that many things can count as a "win", even when at the time most think it's a "lose".

And frankly, with the prospect of the conditions inside of a federal prison, I'd say being a "sore loser" is entirely in the Browns' rational self interest.

John

Keep your head in the dirt for a few more months and then ask that same question.

IIRC there is no statute of limitations on taxes (unlike murder). So those folks are gonna be either in CLub Fed, or the Feds will just turn their "Compund" into a new type of Federal Jail:One owned and staffed by the prisoners.

Not a bad idea, really....
