Tough philosophical question

Is this a justifiable homicide because it stopped a serious crime in progress or is it a murder because a death was caused in the commision of a felony?

I'd imagine, Grizzly, that he did indeed shoot himself in the gut if he ended up bleeding out. Then again, if you were to shoot Captain Winky while in the process of breaking and entering, would you go to the hospital and admit it, or would you rather die painfully.
