And it's an import from Russian factories ban, not the round itself. I wouldn't worry much about the 7.62x39 or 7.62x54R as there are a LOT of spam cans of it already here or outside Russia to not be an issue.

No, the ATF has suspended the import of 7n6 while they investigate if it meets the AP criteria in 18 USC 921(a)(17)(B) because they have become aware of pistols in 5.45x39. This is a separate issue from any potential economic sanctions against Russia.
 
Isn't a lot of the interpretations by the BATFE covered under Administrative Law and not Judicial law. ie: they have a lot of leeway to interpret the law which they are specifically entrusted to enforce as opposed to general law is enforced by many agencies without the capacity for interpretation. Unless specifically denied in the agency law don't the "enforcers" have considerable leeway? I don't know...I'm sincerely asking.
 
Anyone know what the ATF criteria is for 'becoming aware of a pistol' ? Because I'm pretty there's a Contender barrel for everything up to and including 50BMG at this point, and I know for a fact numerous chopped up Mosin receivers have been rewelded into Obrez (Obrez-es?). Is it just commercial availability they care about, and if so, how many before they consider it 'available' ? As you can see, even if the ATF is just innocently complying with the law as written like they claim, it's impossible for them to do so without being arbitrary.

In this case, the definition of AP is clearly stated and 5.45x39 most certainly does not fall under the criteria set forth for AP. They're not following the law. How do we get them to follow the law? I don't know. I would like to know though. What's our recourse? Does an importer have to file suit?

It shouldn't matter. Go read the definition of AP. They really are just making crap up at this point.
