denied at local gunshop in VA

hey guys, i posted a while back asking for your opinions of some different .223 rifles, and yesterday i went to a local gunshop to order a bushmaster XM15 O.R.C rifle, when i was told that i was not of age to purchase the firearm. (im 18) i tried to argue with the clerk but he still refused to sell me the weapon. was there a new law or revision to a law that happened that i dont know about? or did this person just not want to sell me the gun? ( i live in Northern Virginia)
 
No such law. Some gun stores make it store policy to not sell some type of long guns to anyone under 21. I've been told that Green Top Sporting Goods here in Richmond will not sell assault rifles to anyone under 21, but I've never confirmed if it's true.
 
Must be a store policy.

Is it illegal to sell guns to kids?**Partial

State law prohibits sales of a handgun or "assault firearm" to juveniles only if the seller knows that the buyer is prohibited from possessing these firearms (see Juvenile Possession above). There are no limits under state law on selling or giving children 12 or older rifles or shotguns if they are not "assault firearms." Federal law also prohibits licensed gun dealers from selling handguns to anyone under 21 and selling rifles or shotguns to anyone under 18, and prohibits handgun sales by private sellers to anyone under 18. In Virginia the term "assault firearm" is narrowly defined to include only pistols and rifles that are equipped with an ammunition magazine than can hold more than 20 rounds, are designed to hold a silencer, or are equipped with a folding stock; and to only include shotguns with a magazine that will hold more than seven rounds of the longest ammunition for which it is chambered.
 
Will your parents get behind the sale? Maybe store policy can be bent if they see it's a family thing.

In any case, I know you're in for the longest three years of your life... just remember, you too will get to the point where you look back and wonder where the hell the last three went....
 
Weird. Though I know several gun shops are pretty twitchy right now so if you are -just- 18 they might deny the sale just to err on the side of caution.
 
the XM15 ORC isnt classified as an assault weapon is it? its just a .223 semiautomatic rifle, although i believe it comes from the factory with a 30 round magazine.
 
I'd find another dealer. This is from the Virginia code (http://www.handgunlaw.us/documents/StateLaws.pdf):


18.2-308.7. Possession or transportation of certain firearms by persons under the age of 18; penalty.

It shall be unlawful for any person under 18 years of age to knowingly and intentionally possess or transport a handgun or assault firearm anywhere in the Commonwealth. For the purposes of this section, "handgun" means any pistol or revolver or other firearm originally designed, made and intended to fire single or multiple projectiles by means of an explosion of a combustible material from one or more barrels when held in one hand and "assault firearm" means any (i) semi-automatic centerfire rifle or pistol which expels single or multiple projectiles by action of an explosion of a combustible material and is equipped at the time of the offense with a magazine which will hold more than 20 rounds of ammunition or designed by the manufacturer to accommodate a silencer or equipped with a folding stock or (ii) shotgun with a magazine which will hold more than seven rounds of the longest ammunition for which it is chambered. A violation of this section shall be a Class 1 misdemeanor.

18.2-309. Furnishing certain weapons to minors; penalty.

A. If any person sells, barters, gives or furnishes, or causes to be sold, bartered, given or furnished, to any minor a dirk, switchblade knife or bowie knife, having good cause to believe him to be a minor, such person shall be guilty of a Class 1 misdemeanor.

B. If any person sells, barters, gives or furnishes, or causes to be sold, bartered, given or furnished, to any minor a handgun, having good cause to believe him to be a minor, such person shall be guilty of a Class 6 felony. This subsection shall not apply to any transfer made between family members or for the purpose of engaging in a sporting event or activity.
 
It is an assualt weapon but not illegal for you to buy. I say buy somewhere else and then bring it by the store later to show off your new gun. After a few ''DOAT!'' moments they may change policy.
 
Also, call the Gander Mountain store in Fredericksburg. They're a Bushmaster dealer and might sell to you. Won't hurt to ask.
 
+1 for get a new store. If this happened to me, I would post this store's name, address, telephone, their internet site, and the manager's name.

By Hades, if we can put an M16 in the hands of an 18-year-old in the military to go kill the enemy, why can't a person 18-year-old purchase an AR15 to shoot paper targets?

Just one more stupid example of Constitutional violation.
 
May I ask what store in NoVA this is?? We have a couple of outstanding stores here and one or two real louses.

I would urge you to look at going to some place like Virginia Arms in Manassas (unless thats the place that denied you). Gander Mountain is also a good call. As is Greentop
 
i live in a small town called front royal, the shop i went to is right next to the courthouse, sign just says "gunshop"

Dont know that one. Front Royal is a decent sized town. THere's a shop in Winchester (name escapes me) that pretty good, but if I were in Front Royal I'd head over to Clarks Brothers in Warrenton to check it out.

I'm like 99% sure I have seen a sign at Greentops that says they don't sell "assult rifles" to anyone under 21. (Or some such wording.)
 
Find another place.

After you've bought your rifle, take a copy of the receipt and hand it to the owner of the shop that snubbed you. Tell him 'thanks for nothing, that sale could have been yours if you hadn't discriminated', and promptly leave.

Frederick County Firearms is top rate, great folks to deal with. I don't know if they have any age stipulations, might want to call first before making the drive up 81.
 
Guns and Ammo Warehouse in Manassas will sell you one. Also remember you have to show citizenship status with an 'assault' weapon. Birth certificate, voters Card, US Passport, Selective Service registration or Permanent resident alien card.
