My buddy sells a nice rifle on GB, borders on collectible, purchased by a guy from NY, who claims to be retired LE. Purchaser now wants to drive to OH for a FTF!!?? Is Bloomburg at it again? Buddy calls me to explain situation, I tell him it cannot be done,,no such thing as private sale across state lines,, this guy must find an FFL to accept shipment. Buddy calls me back to say the retired LE said it's perfectly legal to sell it FTF!! That he asked a couple FFL's and they say the same!,,his closest FFL will charge too much and will only accept shipments from another FFL, that he insists on picking this rifle up in person,,:scrutiny: I told my buddy to stand firm and find an FFL for the guy, start calling NY FFL's monday,,this is too strange:uhoh:

The guy from NY can pick it up in Ohio, but the sale has to go through an Ohio FFL then. Handguns must be shipped to the buyer's state of residence and transferred through an FFL there.
 
Federal Gun Control Act (GCA) of 1968. Strictly speaking it does not allow for interstate private transfers of firearms at all. Long guns can be transferred out of state only if they are transferred from a licensed dealer (FFL), and handguns cannot be transferred out of state by a non-licensed individual at all.
 
What the General said.
The buyer can drive to the seller's state where they can go to a licensed dealer. The dealer can transfer the long gun to the buyer, must he must abide by whatever regs are the buyer's state. If his state requires an FOID, then he must provide one. If there is a waiting period, the dealer must do that too.

Personally I won't do that. I'll sell to people in neighboring states and other states that follow federal law but I wont even try to satisfy requirements from some state whose laws I'm not familiar with.
 
thats what I'm afraid of,,I don't wanna send my buddy over to my FFL to do the transfer "headache of the week" anybody familiar with NY laws regarding long guns??

That should have been your buddy’s first red flag.

Neither you nor your buddy should be dealing with this, it’s the buyer’s problem. I assume the original deal was to ship to a NY FFL per Federal law; sounds like the buyer has broken the agreement. Refund the money minus shipping, relist the item, make sure he sells to someone in a free state.

Unless the NY buyer is driving a motorcycle it seems to me he won't be saving any money by cutting out his FFL! I smell a rat. Especially when he quotes his FFL as saying that a FTF out of state is okay.
 
call you local cops, if they tend to be gun friendly, ask if maybe they want to do a sting, or maybe someone in the local media???

Don't sell the gun, talk to a lawyer, but with a little imagination, you could get the GB fee back.
