Went to a gun show yesterday & as me & my bud were casually strolling the aisles we were passed by a young (?mid-20's?) rapidly walking toward the door.Just as he passed us a uniformed officer said "Hey!".The kid stopped,raised both hands & said "Ok.".The officer escorted him from the show & cuffed him.
Seems Brilliance went to a licensed dealer to purchase a firearm,filled-out the appropriate form & was shocked to find that the background check came back that he was (is) on probation for a felony("But I didn't put that down!").The dealer notified the uniformed officer,who made the collar.
On reflection I guess Brilliance is lucky the local PD grabbed him as had he actually completed the sale & taken posession the Feds would'a been after him.
Legal Question:had the background check come back "sale approved" on this cat would the dealer have been in trouble? I don't see how but would like a response from our more informed members.
 
Sounds typical of a felon. He'd probably heard some street talk about the "gun show loophole" and wasn't smart enough to go to the library and find out what that meant.

It wouldn't really matter what his felony was, ALL felons are restricted from owning or possessing firearms. IMO, not because they're felons, because they're STUPID.
 
Really, Ive never heard of the NCIS telling why a person is rejected, (ive never had a customer refused by them so i dont have experiance that way) is that something normal? I was told they couldnt even tell a dealer why a person is delayed (I have had that).
 
You'll note that on the new forms, the dealer has to indicate whether or not the firearm is being sold at a gun show. I understand that if he says "yes" to this question, then NICS will advise whether or not the applicant has lied about any of the questions on the form, so that the applicant can be held or arrested on site - something which can be done at leisure in a gunshop setting.
 
Wait...I was told that gunshows were the place where all criminals get their guns.

You know, if they're able to reject, they oughta tell you why. Be _real_ interesting to hear "Uh... You've got a rejection. Is he standing right there? He's a fugitive child molester, with warrants from California, Color... Uh... What was that noise?"
 
I saw a guy in a pawn shop get rejected after failing a NICS purchase once.

It was kinda funny to sit there and watch him bicker with the guy behind the counter.

But then I got annoyed, because the guy behind the counter was the one I needed to ask about a shotgun, and Banny McFelon was dominating his time.
 
I called in a check once and they said delayed, nothing unusual there. 20 minutes later the State Police called back, asked me “Is he still in the store?” Yes, said I, next question, “Is he armed?” Unknown for sure, but, appears not to be. The lady then states “Police are outside, are you able to give a description of what he is wearing and where he is in the store?” He was all the way across the store from me, so I did.

Police then came into the store and quickly arrested him. He seemed to have an outstanding warrant out. :what:

I really wish I could find out what the outcome was, because he was a young G.I. and his wife was with him. He said that he had the same name as his father and the warrant was for him. Made sense because being in the Army he could easily be found. The Police did state is was not a very recent warrant. :confused:

The worst part was getting in touch with a friend of theirs to pick up his wife because she couldn’t drive due to being very upset.

How would NICS know that the potential purchaser has lied about any particular question on the form? Aside from the felony aspect of it, of course.
 
well if he put down yes in the "are you a damn fool criminal" box, the dealer wouldn't waste his time calling it in, now would he? so it gets called in for someone who claims to be good to buy, and the check comes back with "wait a minute, mr jack d ripper is wanted for questioning," one can deduce that there is either a mistake, or a less than honest answer on the paper.
 
I've had (I think) about 12 delays and 1 denial in the past year. All of the delays were in a brief period (a couple of months) and I think it had to do with the computer system more than the customers, since all 12 cleared withing 48 hours.

Nothing ever came from the denial. There was never a follow up call and I gave the guy the "How to appeal a NICS denial" pamphlet. I haven't heard back from him about buying another gun though.
 
Wow, judging by some of the responses here I wouldn't want to be the one who gets a mistaken NICS denial with you guys around.

And what about people with warrants who did not know they had warrants? I know more than one person who has had a warrant put out for his or her arrest due to a forgotten or screwed up (by the court, of course) traffic citation that was never paid.

Think it through. If they have a warrant they are unaware of, it is going to bite them sooner or later. Why is it so horrible it happens at a gun shop?

If it is a mistake, they clear it up, same as they'd have to if it popped after getting stopped for a taillight. A horrible inconvenience, but hardly the gun sellers problem.

If the NICS comes up denied, and it is because of a warrant, what do you want gun store employees to do? Not take action because it MIGHT be some bureaucratic foul up?

the fbi does not tell the dealer why a person is denied.

where i'm from if a person is denied, they give them this pamflet from the fbi so they can find out why they are denied.
 
Having an arrest warrant in effect against oneself, without knowing of it, is very much possible. Suppose you have recently moved your residence from one State to another, and someone gets mad at your driving and decides to have the police exact his revenge. He drives off the road to damage his vehicle, telephones the police and files a hit and run report, giving your license number. Since he has filed a felony complaint against you, the local police try to track you through your out of state license plate. The police in your old State of residence determine that you have moved out of State, and report that back to the police in the jurisdiction where the supposed hit and run occurred. They now have a warrant issued for your arrest, but they do not know where your new residence is located. Since you will have obtained a new license and plate for your vehicle, and the original warrant was based on the out of State license and plate, you may go undetected for years. If you have a very common name, and something like this occurred to someone else, it is also possible that you could be arrested on the basis of mistaken identity. You would probably be flagged during a NICS check under these circumstances.

In either case, a false report or mistaken identity, you can find yourself on the wrong end of a policemans gun, with a trip to the jail in handcuffs, followed by a long question and answer period until you clear yourself of suspicion.

Insurance scam artists like to do stuff like this, so don't think it can't happen to you.
 
Right. But how is that the dealer's problem? What are they supposed to do about it?

Take a denied person's word that "it's all a mistake"?
 
Hum, what makes a felon? Now a days you can spit on the side walk and be declared a felon.

Child support payment? Unpaid traffic tickets?

Every time we get out of bed in the morning to the time we go to bed a night we begin to break laws unknown to us. Which one was big enough to get us branded as a felon?

There was a time in this countries history that when a man finished his prison sentence he was handed back his gun.:)
 
To DunedinDragon and for all that read my post ( #16 ) on this tread: I'm very sorry for my conduct and the things I said on that post. I was very wrong in the things that I said and it was not very professional of my self. I ask for forgivness from all of you at the Highroad and most of all from DunedinDragon. Once again from the bottom of my heart I'm very sorry.
 
So your telling me the systems works!! Wow according to the Brady bunch every hoodlum can buy guns at gunshows.
