While there were no firearms involved in this incident, there are some worthwhile insights to gathered from this story:

MOUNT LAUREL, N.J. -- Enraged after being cut off by a teen driver, authorities say a man then followed the high school athlete home and tried to run the youth down with his car. Instead, the 53-year-old was punched into unconsciousness and died Tuesday.

The teen was jailed, charged with aggravated assault.

Jeffrey Zucker, a lawyer for the 17-year-old, said it was a case of self-defense.

The charges against the boy, whose name was not released because of his age, were filed before James D. Munter died late Tuesday morning. The charges could be upgraded, but Bill Shralow, a spokesman for the Camden County prosecutor's office, said that decision would not be made Tuesday.

The youth cut off Munter, of Lindenwold, on a road in Laurel Springs on Monday evening, authorities said.

Zucker said the teen was on his way home from football practice around 5:30 p.m. when he inadvertently cut off the other driver.

Authorities said Munter followed the teen three miles to the student's home in Lindenwold, screaming through his window all the way. The teen used a cell phone to call his father, who told him to drive home, officials said.

When the teen arrived home, Zucker said, he ran across the street to his home from his still-idling truck, but he was not fast enough. With the teen's father watching, Munter drove into the youth, authorities said.

The teen, who Zucker said is about 6-foot-6 and 300 pounds, rolled off the hood of Munter's 1999 Mercury Sable, landed on his feet, walked to the driver's side of the car and punched Munter twice in the head.

Munter's son-in-law, Mark Serota, who described the man as "nice, fun-loving, goodhearted," said he lost consciousness instantly and never regained it.

Serota said police had asked the family not to talk about the details of the incident, including whether it seemed in character for Munter to follow or confront someone he considered to be a rude driver.

The teen was ordered to remain in the Camden County Youth Detention Center, at least until a hearing scheduled for Thursday.

Zucker said he hoped his client would be released to his parents then.

"It's a true tragedy because it certainly escalated into something that shouldn't have happened," Zucker said. "He was almost killed."

Zucker said three officials at the school where his client was a junior wrote letters supporting him, praising him as a good student and good citizen.

Gerri Carroll, the schools superintendent in Lindenwold, said extra help was available Tuesday for high school students who needed support after hearing about the incident.

The boy, she said, is an "excellent student, which is why this is very uncharacteristic."

A tragedy to be sure that a man is dead, but it "appears" as if he pursued this teen and deliberately tried to run him down with a deadly weapon, a moving motor vehicle. If I were in the teen's position I would probably have done something also. I think most of us would have.

I wonder if the father had called the cops before the teen got home?
 
Only in New Jersey would the teen have been arrested and locked up for this incident. The driver clearly intended to do him serious harm or injury. It was not safe to simply try to 'walk away' again. The teen tried once already to 'walk away' and was nearly killed. Even if it was anger which motivated the teen to punch the driver twice, the force was warranted under the circumstances, in my opinion.

While I would've driven to a police station and not my home, the teen was following his father's instructions. I don't fault the teen for following dad's instructions during a stressful incident like this.

In the same situation, I would've shot the driver until he was no longer able to direct the vehicle at me.

not sure I'd use great to describe it. After all, someone is dead, and a teenager was locked up for defending himself.

yea NJ can be a hellhole. Our state govt really hates it when citizens defend themselves. and to clarify, the kid was hit by the car. after he was hit he got up and punched the guy. The prosecutor said that because the guy was still in his car, he didnt have a fighting chance and couldnt defend himself or something like that. Gee, dont expect me to think that clearly after I get hit my a car. :fire:

Yet another reason to avoid the armpit that is NJ at all costs. Hope this kid gets off. Stupid people should not be allowed to consume oxygen and he saw to it that one less would.

The man had just run the kid over. What do you want him to do? Apologize to the guy for getting in his way?

He was just run over maliciously by this guy, had he not acted, the old man would probably have continued his attack. The athelete simply neutralized the threat.

What's his size have to do with anything? It's okay to try to kill a football player with a car? The driver put his cards on the table, he made his intent clear. There's nothing in the law that says you can't be mad when you defend your life. Punching the guy twice seems like a rational, controlled response.

Don't bite off more than you can chew.
 
What a tragedy. That kid is gonna have to put on every job application that he was arrest. All because of some idiot that didn't deserve to breath. Too bad the kids dad didn't have a gun and save the kid the hassle of being arrested.
 
Oh no, if the father had had a gun and used it, he would be charged too, and premeditation added. After all, he called his father, and the dad was waiting for the man to arrive and....

Has this prosecutor announce which office he's running for on a "hard on crime" platform? :cuss:
 
UPATE: A family court judge ordered the release of the youth from a junvenile detention center. The youth will play in tonight's (Friday) football game.

The prosecutor is not sure if he will actually prosecute or drop assault charges. He doesn't sound too enthusiastic about the case.

As an aside, the youth is the one who called for medical assistance for the idiot driver who just tried to murder the youth.

Looks like this story is going to have a really happy ending.
 
It looks like he was being held as a procedural thing untill a judge could review the case. I dont necessarily agree with that, but it does take time to get all the facts straight.

From what I heard on the news this AM, the charges will likely be dropped. I hope the parents don't settle for just that. They need to get the court to acknowledge that the arrest was so stupid and unwarranted, that it is expunged from his record. Good luck on that.

The man died of a ruptured blood vessel in his head. They aren't sure yet if that was caused by the punch or if it may have already ruptured and caused the behavior.
 
The kid is 17. He is a minor. He won't have to mention any arrest record to future employers.

In fact, when I was in management we only asked about convictions, not arrests.

I am guessing that this kid will get a football scholarship to one of the big colleges.
 
The kid was attacked with a letal weapon (car). He defended himself. It's ridiculous to arrest him.
 
FWIW, according to New Jersey Statutes ....
"The taking of a juvenile into custody shall not be construed as an arrest, but shall be deemed a measure to protect the health, morals and well being of the juvenile."

So, the juvenile was NOT arrested. He spent a night or two in juvenile detention with kids his own age until the prosecutor had an idea of what happened. Big deal. The juvenile court judge let the kid out so the kid is NOT considered a danger to the community.

Most homicides are reviewed by the Grand Jury but in this case, since a juvenile is the actor, I am not sure that will actually take place. It may be left to the descretion of the juvenile court judge.

You ever been hit by a car? It's not easy to collect the necessary information to make an accurate determination as to the intent of the driver at an arbitrary moment. Try figuring out if the engine is running while your ears are ringing from smacking your head on the pavement.

Hope it turns out well for the kid and that the family of the dead moron can console themselves with the belief that his "burst blood vessel" caused his rather intentional violent behavior.

I agree. The teen had already satisfied whatever "duty to retreat" he may or may not have had when he tried to leave his truck and get to his house. He made no attempt to confront the man, and only acted directly AFTER the driver initiated a violent confrontation. Certainly any reasonable person could safely assume their life was threatened when someone follows you home and hits you with their car.

If someone cuts you off in traffic, get over it. A 53 year old man should know better.
