New York Senate passes increased assault weapons ban

Passed senate 43-18.

Expected to pass house without resistance tomorrow morning. Provisions for 3 day debate are waived via Governor order.

Of significant note; it appears the two-century-old Remington Arms company (which owns Bushmaster) will be heavily impacted by the new legislation and may be forced to relocate.
Maybe they can move back into the old Marlin factory in CT and rehire those folks to start making Marlin again instead of their Remlins.

Bad news. Sorry for those of you living in NY. My state is now sandwiched between two of the few states that have "assault weapons" legislation. I hope this doesn't set a precedence of some sort. Looks like I'll be contacting my lawmakers yet again.
 
Some of what was passed is unconstitutional and won't survive a court challenge.
How so HSO? I haven't read the bill, just reviewed some of the comments in brief. What part might be unconstitutional and hopefully so.

*IF* the Illinois CCW Federal case goes well for gun owners, it's possible that the Supreme Court might be more compelled to get involved because they'd have two districts with opposing rulings.

HOWEVER, even if the Supreme Court does so, there's no guarantee that the outcome would be favorable, nor is there any guarantee whatsoever that they'd touch on "assault weapons" in their final verdict. They might just stick to the handgun / CCW issue.

Otherwise, it's going to take a LONG and EXPENSIVE process of trial, appeal, appeal, appeal to try to get pieces reversed.

And each time it means some poor gun owner's future is on the line, because to get in to a position to appeal it, it means first being charged with a crime. We already KNOW that the state and federal courts up to the district level will NOT rule favorably for gun owners in New York, which means it has to hit the Supreme Court.

And it has to do so BEFORE Obama has a chance to make an appointment to it (from retirement or death of a Justice; a couple are "getting way up there" in age).

It's not good, not good at all...

We are only one SCOTUS judge away from losing everything. Very unstable foundation at present. Hopefully that won't happen, but it is going to be a long 4 years that has not yet even started.
 
What really gets under my skin, is this truly was passed with bipartisan support. There were some that were against it, but so many were quick to throw everyone under the bus.

Yes, the GOP and the DEMs are all on the same team, just playing different roles, but the end game is the same. Really shouldn't be a surprise to any of us unfortunately.

I prefer to see things rationally, logically.

But dude.. this is major. This will embolden New Jersey, Massachusetts, California, and other states.

We could have just witnessed the first domino to fall.

WHATEVER he used to sway the Republican majority behind closed doors to cave in so completely, must have been shockingly strong.

I don't think gun owners have ever been in this perilous of a position since this country was founded.

The anti-gun crowd are making incredible gains in only one months' time.

And Big O hasn't even been sworn in yet this term.

The next 4 years ... are going to suck. We're on the defensive hard core, and losing ground fast in public perception.

+1, this is NOT going to be over in a week or two, we are witnessing the beginning salvos of a very intense and long run against the 2A at state, local and federal levels. This is just the opening salvo of what could be a very painful period of time. No matter how long or short it is, it will be painful for all. Bend over and do you know what if we are not careful.
 
Require a therapist who believes a mental health patient made a credible threat to use a gun illegally to report the threat to a mental health director who would then have to report serious threats to the state Department of Criminal Justice Services. A patient's gun could be taken from him or her.

Limit the state records law to protect handgun owners from being identified publicly. The provision would allow a handgun permit holder a means to maintain privacy under the Freedom of Information law.

The legislation also increases sentences for gun crimes including the shooting of a first responder that Cuomo called the "Webster provision." Last month in the western New York town of Webster, two firefighters were killed after responding to a fire set by the shooter, who eventually killed himself.

I think the first one should apply regardless of tool, as should the third. Take out the "gun" and make it a requirement to report a credible threat of violence or taking violent actions against a first responder, and these bits are actually what I would suggest putting into legislation, personally. The second is a good idea. Other than that it's complete...well, what I want to say the mods would edit and then send me a nastygram, so I won't say it.

"You have 1 year to sell it out of state"...oh I wish I could get permission to be non-high-road for a minute with my language. Luckily I don't live in NY, but I'm not taking the "at least its not me" mindset and ignoring the problem.

Keep contacting your lawmakers. Heck, if you've already contacted yours contact mine in PA! Can't hurt. Or contact the lawmakers in NY, particularly the house of reps since they haven't voted on it yet.

New York Logic. BAN EVIL ASSAULT RIFLES!

FACT: In New York, in 2011, *5* people were killed with rifles (of any type, not just evil assault rifles)

Out of:

372,255 property crimes.
287,547 larcenies.
65,397 buglaries.
45,568 aggravated assaults.
28,396 robberies.
19,311 motor vehicle thefts.
2,752 forcible rapes.
774 murders.

CLEARLY assault rifles, having killed *5* whole people in the state, represent a CLEAR AND PRESENT DANGER to public health, and justify making over 1 million residents criminals.

FACT: Tyranny and fascism are alive and well in the United States, today.

maybe maybe not... seems like the people who have been seduced by the antigun campaign would still see this as support of the 2nd amendment with "reasonable restrictions". not only will this do away with scary black rifles, but scary black handguns as well. All while still supporting the hunters and sportsmen... Hunting rifles don't have the terrifying pistol grip and hunting shotguns are more or less left alone too... In conclusion, this still "supports hunters" and "keeps the people safe from all the crazies with guns".

This crap proves what we've said all along.... give them an inch and they use it against us.
NY already had a hi cap magazine ban over 10 rounds, like the feds are trying to push thru. Now NY is changing it to 7 rounds. What for? Just because they can. 7 or 10, what's the difference other than tightening the knot until they get it down to 2 rounds or even 1 round. No grandfathering.

No internet sales of "assault weapons"? Since any transfer has to go thru an FFL, why ban the sale? If it's illegal the FFL won't process it. What does this accomplish? Nothing but more control. It will lead to more restrictions down the road once they get their foot in the door. This is sic.

This is total abuse of power. Anyone who votes for this ban should lose their positions. I believe there are enough gun owners in NYS where their vote will make a difference. Also, the NRA needs to step in with a lawsuit to reverse this useless bill. It's sickening. States that feel they are above the US Constitution should have any legislator who votes for restrictions charged with a crime of treason. Make them pay for their wrongful acts.
 
This has GOT to end up in the Supreme Court as violation of the "Common Use" wording from Heller and Miller.
