If I remember correctly, in 2001 the ATF reclassified Streetsweeper shotguns as destructive devices and had an amnesty period which required registration and tax paid, but no fingerprints/photos. Hypothetically, if one bought say a Saiga 12, then moved to a non-NFA state only to have said gun NFA'ed by the ATF, where would that leave the gun owner? (assuming the gun was stored safely in the class 3 state) Could you register such a gun sight unseen with only serial numbers?:confused:

I just feel that we, as a country, have at least one federal law which defies the Constitution, that being the 1986 machine gun ban, as well as the 1934 national firearms act.

I think (know) that both of these defy the Constitution, and that without the Constitution, america is not America as it was meant to be.

I also happen to think (know) that the Founding Fathers agree with me and that any modern politician that disagrees with me is unAmerican, and thus, my enemy. Extreme? Fundamentally, no. But as of today, sure. American and satisying of my duty? Absolutely.

Final question; does this answer your question? Absolutely not. :) I'm just upset and missing my country.

Vegaslaith , I don't recall hearing anything about that. Considering that I can still buy the Saiga 12 off the shelf at more than one local gun store, I think maybe you have some bad information?

Rumors about the Saiga 12 being ruled a DD have been floating around for at least two years. I doubt that it will happen anytime soon, if at all. If they really were going to, I figure they'd stop the imports before they did that. As to your original question, you'd probably have to give it up.

The old "designated as a DD" myth has been circling ever since the 20 round drum came out for the saiga. It might happen.

In my opinion, if you move/live in a non-NFA state and one of your guns gets classified as NFA, your either SOL or you need to gift that item to a family member who lives in an NFA friendly state. This is just my opinion of course.

That's more or less what I thought, birghamr. So I'd pretty much be screwed, basically. I'm the only guy in my familiy who knows/cares about 2A issues and lives in an NFA state. So what do you guys think? I want an 12GA autoloader before year's end. Should I pass up the Saiga 12 based on the above concerns and get say, a Benelli instead? Its just that I wanted something genuinely Russian not just a Romanian or 922r compliant copy. just doesn't feel right IMO

unlikely

The whole "streetsweeper"/striker 12 re-classification was a ruse brought about by a sustained and focused anti-gun publicity campaign that was preaching to a friendly agency overseen by a non caring congress and supervised by a friendly President; and the only legal recourse was the courts which were at the time decidedly anti-gun.

In essence, it was a perfect storm for us. In this time frame you have to look back at this sustained publicity campaign to those all too willing to fall for the lie and the way to get those last "digs" in against the pro gun community. Could it happen with the Saiga? Anything could. But the antis have bigger "whipping boy" targets in their sights right now.

If you were hypothetically in an NFA unfriendly state and there was an amnesty registration period issued then yes, you would be stuck. More than likely you would have to sell it over Gunbroker or similar agent or consign it ot a C3 - possibly a C3 in an NFA friendly state. So you could get some compensation out of it but you might not get what you have in it.

I don't know, but I wish I still lived in "America".

I feel the same way, and this November, I will go out there and make my voice heard at the polls.

Did anybody get a Survey from the NRA yesterday? The message is clear and simple. Your future depends on you.
