Let's skip the legalities for a moment, since I haven't seen any answers from LEO"S or attorneys any legal answer would be frought with problems to begin with. What I would like to know is how you "feel" about the deal. It seems to me that you are uncomfortable with the sale or you wouldn't be on this forum. As a person that deals with addicts and alcoholics on a regular basis I have to say that I wouldn't sell a firearm to anyone that only has a short time in sobriety. They are just too brittle and prone to re indulge, and a person under the influence is not the kind of person I would prefer to have a deadly weapon. Let him get 6 or 7 years clean and sober and then see if you feel better about selling him a deadly weapon. FRJ
My main concern would be if he gets in trouble with it some how or, heaven forbid, commits suicide, The family may be mad at you for providing the gun.
I would not risk it myself, but only for those reasons.
