Agressive Dog

Where I live, if you shoot a neighbor's dog, nobody but you better know it, (and you should have a big loader-tractor handy and a discreet place to dig a deep hole pronto).

^ Redneck reciprocation? Ashevilleish area? I guess you would just have to develop a respectful relationship before hand...if possible.

Not sure what you mean, but though I've never shot a neighbor's dog, I would if I thought it was an imminent threat: i.e.: Wolf/Shepherd hybrid, or Pit Bull that seemed aggressive, etc. if they were running loose on my property, and no one would know. And don't bother defending these animals with tales of "no bad dogs, only bad owners". That's bullcrap. Notice every time a child has it's face ripped off and trachea removed by a Pit Bull, the owners end up on the six-o'clock news blubbering about how "Killer" was "the sweetest dog they ever owned and never hurt a flea, and really liked kids", bla bla bla... It's a fighting breed, bred for aggression, and a kill, not dominate, but KILL-the-opponent hardwiring. That makes them dangerous. Period.

Do you leave your dog out unattended? Without a fence or leash? If so, you and your neighbor are both wrong

Wrong.

At least here in Virginia, you have every right to allow your dog unfettered access to your curtilage, leash or no leash, fence or no fence.

If your dog runs at large (i.e., off your property), that's generally a no-no. But no one can fault you for allowing your dog to be loose all day, if you so choose, so long as your dog stays on your property.

If another dog attacks your dog on your property, you can use as much force as is necessary to stop the attack. My definition of "necessary" is 12 pellets of OOB ... and 48 more, if need be, from an Auto-5. deal.gif

Then you call the sheriff.

Then you call the neighbor.

"I doubt he'd need to, a 180 GSD is morbidly obese ... wouldn't be able to catch the jack russell in that case."

Haha, yes, very morbidly obese. Ever notice those Czech bloodline GSD that the police and military use for K-9s, those are full grown at 70-75lbs (the perfect weight and size for the breed, American bloodline GSD are too big, heavy and have way too many health problems).
Document with the police, video record any further incidents, document dates, times, witnesses.
Get a bottle of wolf urine, spread it along the border or the yard by the street or sidewalk, all dogs (small mammals, bears, coyotes, cats, foxes, etc) are seriously afraid of the smell of wolf urine.

We had a leash law back where i use to live in florida and a nieghbor with several dogs would let them run at night. After they came by and growled at my wife and then me i unloaded 6 rounds of 357 rat shot on them went back in and called the nieghbor to remind him of the leash law and if his dogs came over and tryed to bit me or anyone in my family i would kill his dogs and put them on his door step. I then asked him if he had a problem with that . he said NO. I found out watch'n tv a couple nights late he was the ass. district att. for our county and his brother was the DA. Some times it does pay to be lucky ,I know if i ever went to court for anything i would have that book slapped up the side of my head. My ADA nieghbor never ever looked at me or in my direction as long as i lived next to him. I gave his dogs away reather than build a fenced area or atleast a run.

OP,

No need to shoot the dog for the owners stupidity... as others mentioned, just get a can of mace. I carry one on hikes because there are constantly dogs off the leash on the trails... I even got bitten once while biking. We have a leash law here that virtually no one follows. A quick blast of spray will send the dog running. If the neighbor threatens you afterwards, give him a blast as well.

Be careful

I was an animal control officer in Ma. for several years. I can only state what was legal at the time in this state. Killing a dog that was acting in a manner that made you believe you were going to be attacked was legal. Be aware that where you are, whether you endanger someone via your actions, how close to a road or occupied building you are, and the actual form of defense are all going to be added to the equation. You are better off using a non-lethal form of defense and avoiding a lot of repercussions, albeit probably not all. Mace does not work well on dogs. Pepper spray does. Ammonia is water soluble and volatile, so it disappears quickly. Pepper spray is oil based so it lasts longer. This is why hot peppers burn your mouth much longer then Horse Radish or Wasabe as they are water base and the peppers are oily. The pepper spray will also stop the dog owner if he or she gets violent when you spray the dog. The spray used on bears is really harsh(it must be, it stops Grizzlies) so find out the legalities on all defense items BEFORE using.
Good luck.
