In Texas?

I found a place in another state that is selling a gun that I want more then one of since they are pretty cheap, It says there is a discount for ordering 5 or more so I figured I would buy 5 or 6. I would keep 4 for myself and maybe give the others as Christmas presents to my Dad and my best friend. both of them have there CHL so they are not criminals lol I just dont want them to know Im buying them a gift until I give it to them.

I was wondering if there is a limit to how many of the same gun someone in Texas can buy at one time

Any help is appreciated. I cant seem to find the answer on here or on the net. Im not really sure what to search for either

So if I go to my normal dealer here in Texas and tell them I am going to use them to do the FFL transfer on an order from another shop of 6 pistols then I will be ok, If the BATFE contacts me and asks why I got so many at one time I can explain it to them, I just did not know if I would run into some sort of problem if I ordered 5+ guns at the same time. I buy my Dad a gun every other year or so so giving guns as gifts to me is normal. I just want to make sure I can do it before I contact the seller to place the order.

Since you are also in the free state of Texas you can buy as many as your truck will hold with no problem (or as many as you afford shipping for).

I would rather have the dealer transfer me one per week than risk him filling out a multiple disposition form for six handguns.

Also, in Texas, on a multiple purchase, your FFL dealer has to report the sales to the local LEO. Just found this out, since a friend purchased several Caspian frames at Perry and had them shipped to our FFL guy here. Once he receives them and does the transfer, he has to take a copy of the paperwork to the local sheriff. Of course, he's done this before and the sheriff for that county just round files the stuff, since he does not consider multiple purchases a problem.

Buy as many as you like. No restrictions in Texas. At one time, I was buying firearms in "three's" and the local dealer kind of got tired of all the transfers and the notifications to BATF. It was not uncommon for me to buy 4-5 guns at some of the big gun shows in one day. I was single and those days are past. But it sure was fun at the time. Most of those guns are "past too" as things change.

It used to be that you could purchase 5 firearms at a time. Now it is 3 per BATF approval.

Source? How new is this? I haven't heard anything about it.

As far as I know, you should be able to leave the store with all of them at the same time. As mentioned, a multiple handgun purchase form will be filled out, which will included your name, address, SSN, etc., as well as the make, model, serial number, and caliber of the guns.

You should check with your dealer and try to work some sort of deal on the "mass transfer." Some dealers charge a transfer fee per gun, some will cut a deal on multiple guns.

The last purchase that I made was to buy 3 Mosins. I was able to purchase 3 on one call, and that is the number of firearms description lines made available on the form.

If I had wanted to purchase a 4th firearm, I could, but I would have to do so on a separate form, and the firearms manager would have to have made a separate/second call for approval, because each form must have its own approval number.

Edit to clarify: I am not saying that you can purchase only 3 per day. I am unaware of any per-day limit. But there is a per-call, or per-form limit, and that limit is 3.

This is a great thread! I frankly do not understand why there should be a limitation whatsoever. If a person is lawabidding, has the money and wants to purchase 15 Mosins why should he or she not be allowed?! For my part, the Mosin's cost-to-quality ratio is such that I wanted several of them, and that while they were readily available and were on sale.

In Texas (where the OP is from) with a CHL (which I assume the OP has, since his relatives/friend have them), they don't need to do a NICS call, so you can buy as many as you want, you just need to fill out a 4473 form for each 3 you buy.

I've bought multiple handguns a few times from from the same dealer at the same time, and never heard anymore about it. But they were mid-higher end guns, I guess if I'd have bought 10 cheap .380s they might assume I was going to resell them to gang bangers or something, then they might have come and had a chat with me.

elric is right, you can buy as many as you want, you just got to fill out the forms.

And is up to BATFE or the sheriff department or whoever checks on guns transactions to go and have a chat with you.

In Texas, if you have a dealer that knows the law, you can buy as many long guns as you like at a time. You only have to fill out a 4473 for every 3 you buy.

Each form does not need a number, it's 'one number per transaction (whether your transaction is one firearm or 60)'

If you buy more than one pistol per 5 days at the same FFL dealer, they have to send in a form to the alphabet boys, but this does not restrict you from buying 50 at once, if you desire.

If you have a Texas CHL, no NICS check is required (but they still send the multiple pistol purchase form, if you buy more than one at a time)

Some dealers charge a transfer fee 'per form', but that is their choice, not the law.

A responsible dealer would ask you questions if you tried to buy a large quantity of the same handgun. I'm pretty sure an FFL has the legal right to deny you a firearm if he believes that you are in turn going to sell it to a third party.

Wrong answers, just because there is only 3 lines per 4473 an addendum can be stapled to the 4473. No limit on the quantity. When the guns are handguns, a multiple hand gun purchase will be filed by the FFL.

Some FFL’s cannot read the material supplied by the BATFE.

In CA. You can buy as many as you can afford but you can only DROS one every 30 days

Well I talked with my dealer and he said I could buy as many as I wanted and if it is 2 or more I would have to fill out one of those forms, not 1 for each pair or one for each 3 just one if its 2 or more at one time, now, If I went in a bought 2 on Monday and filled out the form and went back on say Wednesday and bought 2 then I would have to fill out another form, but if I buy all four at the same time its only the one form to fill out and send in. Thats how I understood it anyway ,

My only problem now is...He told me that if I buy lets say 6 then someone might show up at my house a few weeks later to come in and look at my guns  I dont want anyone coming to my house and looking at my guns

And whats the law on buying an extra one or two and selling them for the same price, or giving them to my relatives as a gift? If I did sell any of them I wouldnt sell them to someone I did not know and trust , and I really wouldnt try to make a profit off of them :barf:

mpanova,

If it were me I would rather fill out a couple of forms then run the risk of themn coming to look at your guns, MY fear is you would get on a list and then who knows when they might show up again to "check" on somthing, Yes I know I am being paranoid, but paranoid is just good thinking when the whole world is out to get you. ANd if you have extras you want to give away, I am down in sugarland.

As for me I buy as many as my wife will let me

gun purchases

Also in Texas and need to be advised on purchase of more than one handgun. My FFL informs me that as a non licensed buyer of a handgun, the law reads i CANNOT buy more than 1 handgun per week! Is this in fact law, or is my FFL wrong? I've bought 2-3 handguns at once online and had shipped to my FFL, he in turn tells me he can only legally transfer 1 handgun every seven days to me due to me not having a CCL. So what is the stright poop on this please?

My dealer told me to order what ever I wanted and he would just have to do the transfer for each one as if it was an individual purchase and then I would have to fill out the multiple hand gun purchase form but if I do buy them all in less then 5 days then someone might contact me and want to drop by my house to look at them. Not sure how I feel about that but We'll see how it goes Im ordering 3 on Monday

Bull-oney. The CHL has absolutely nothing whatsoever to do with your ability to purchase/not purchase a handgun in the state of Texas. It exempts you from your FFL having to call up NICS when you make a gun purchase - paperwork is the same. Contrary to what your FFL may want to tell you, the CHL does not bestow magical powers on its holder... and there is no limit to the number of guns you can purchase in a single day/hour/minute in the State of Texas. Or on a Federal level.
Is your FFL trying to get you to attend his CHL class?

The BAT(FE)-men may check up on you after multiple purchases in a week, to make sure you're not buying all those guns to sell to local criminals, acting as a gun dealer for the underworld.

FFL

No, my FFL is a retired peerson who just does this as a parttime job, doesn't even have a store front! Thanks for the stright story, i'm sure going to inform him he better read up on the laws, it does get tiresome running back and forth every seven days to pick up one handgun at a time! Hummm, just an idea, maybe he is lonesome for someone besides his wife to talk to? LOL

What about C&R guns? I've had multiple rifles (10+) sent at once no problem. I know C&R handguns in CA still have to go through an FFL 01 with the 30 wait for each one. Anybody know about other surrounding states?

Justin

Any more than five at one time usually gets you a visit from a nice Agent of the BATFE wanting to know what the heck you are up to.
Unless you live in a state that restricts the number, there is no legal limit to the amount you can buy and if you satisfy the agents curiosity there will be no issues with these folks from then on either.

Just to clear up a few things that have sort of already been cleared up:

The last purchase that I made was to buy 3 Mosins. I was able to purchase 3 on one call, and that is the number of firearms description lines made available on the form.

If I had wanted to purchase a 4th firearm, I could, but I would have to do so on a separate form, and the firearms manager would have to have made a separate/second call for approval, because each form must have its own approval number.

Not true. Next time you buy a gun, turn over the 4473 and read section 14 under "Instructions to Transferor/Seller."

It states:

14. If more than 3 firearms are involved in a transaction, the information required by Section D, questions 26-30 [this is the area where your dealer writes the make, model, caliber, type, and serial number of the guns you are buying] must be provided for the additional firearms on a separate sheet of paper, which must be attached to the ATF form 4473 covering the transaction."

In other words, by Federal law (state laws may vary), you may buy as many guns as you please at one time on one NICS check. There are only 3 lines on the 4473 for guns, but your dealer can add (staple) an additional sheet of paper to list the others. I have done so on several occasions.

My FFL informs me that as a non licensed buyer of a handgun, the law reads i CANNOT buy more than 1 handgun per week! Is this in fact law, or is my FFL wrong?

Your FFL is wrong. They even have a form (ATF Form 3310.4 "Report of Multiple Sale or other Disposition of Pistols and Revolvers") to fill out for buying more than one handgun at a time. Ask your dealer why they would have a form for something that is against the law.

Some FFL’s cannot read the material supplied by the BATFE.
Clearly, based on the information on this thread, this is correct.
