Felony or Misdemeanor matters not. It will still get you in a world of trouble, could affect employment, cause severe financial hardship in legal fees, and deny your ability to own a gun at all.
 
Unless I'm mistaken, a Mini14 with a 5rd magazine, standard non-pistol grip or collapsible stock, and no muzzle break/flashhider/threaded barrel would be legal, correct? Same for an Saiga .223 or 7.x62x39 with a 5rd magazine, right?
 
From what I understand is that certain infractions are a misdeameanor offense, no doubt set to eliminate thaf harshness of a "felony" conviction and losing gun rights. However, you don't have to be convicted of a felony to lose your rights. Misd. domestic violence convictions are a prime example.

I wonder if NY State will now take more gun rights if convicted of a misdemeanor gun related offensese.

True. But in terms of how much resistance the Antis could expect, a felony punishment will end up getting some church minister with 4 kids who has never been in trouble with the law on the nightly news, possibly national news. Whereas the same guy who has to pay a $1000 fine and do community service for 60 hours probably wouldn't rate a 2 sentence mention in the local paper. So you get the same effect as an Anti without generating as much resistance. And after a few years when it doesn't diminish crime you can argue that enforcement and registration needs to be more extreme etc etc ad nauseum.
 
Killian, WHO CARES? They are making an open attempt at making YOUR GUNS illegal. This isn't subterfuge.

If you are a gun grabber, you care. Because you will meet less resistance in getting your laws passed--and upheld--if you aren't seen to be heavy handed. Plus which it gives the same effect without generating resistance. How many people want to hold on to their 20 magazines if they know each one could end up costing them $1000 and 3 months in jail? Most gun owners I've met are honest people. If this is the law, they'll comply. It's an infringement of their 2A rights, I'm completely agree. But until it is overturned, it is the law in NY. Better to debate the issue now and have some idea of what is coming than to get blindsided. A felony is a big difference for both the people who are trying to get this stupid law passed, but also for the people who would suffer the consequences if convicted under this law. It's a very important issue.

Incorrect.

The law proposed states that if the rifle has a CAPACITY to accept a high capacity magazine, it is an assault rifle.

It says NOTHING about actually inserting a magazine in to the weapon. If there IS a high capacity magazine for that rifle, and it will FIT in that rifle, it qualifies.

EDIT: Actually I might be incorrect. :)

Looking through it again. I swear last night I read that it just had to have the ability to accept a high capacity feeding device.

Which part of the bill says that you cannot own a gun with the capacity to accept a large magazine?

So apparently none of these politicians read those NY Post articles detailing how NYC cops got in a fire fight with some perp and fire 68 times hitting the guy twice... it happens every couple months it seems.

A perfect example for why, if guns are the evil agents of destruction, that even the police should be limited to 7 rounds in NY. Less innocent bystanders hit by stray gunfire. Please send this information over to the various police unions and let them know how much safer the legislature is making both them and the public.

It's arguable that this could be the forestock.

A handgrip *OR* a protruding grip. By the reading of this one can infer there are two types of grips - one which protrudes, and one which does NOT.
 
Another question.

What if you're driving through New York?

Have to go AROUND it?

What about flying with a rifle in check luggage that's banned?

Have to go though a different airport?
 
Last I checked, this ban will cut off the transport (by ground) to SIX states in the Union.
 
Federal Peaceable Journey Law would apply. You would have to follow the basic rules in accordance with that law.
 
Maine, Connecticut, New Hampshire, Vermont, Massachusetts, and Rhode Island gun owners should be very angry with New York right now.

When this passes can no longer receive firearms, ammunition, or many firearm parts via ground transportation. All materials will have to be airlifted in to those 6 states.

By my understanding that protects PRIVATE individuals. Not shipping companies.

This sets an expiration date on the second amendment in New York (lifespan of current owners)

No. There is no NY border patrol with fences and checkpoints. NY does not get to block mail through its borders en route to the other states. Canada does it to us, but Canada is a separate nation. NY ain't. It has no authority to block interstate transit through its territory.

I assume you mean the ITALIAN who pushed this law through. My people came through NYC speaking little or no English and couldn't get out of that hell hole fast enough and into free country out west. It's not the immigrants who ruined NY, it's the elites who've dominated the state and city since the days of Tammany.
