Do you know of anybody who you think may have possibly carried a CCW without a permit? Were they ever caught (no need to call out names)? If so, what happened? Please indicate the state.

Feel free to correct me if I'm wrong. I believe it used to be a 2nd degree felony in Florida, but they made it a 3rd degree felony not too long ago. It's not a good idea to do so, get a CWL and no worries.

This may be off topic a little bit but am I allowed to carry a handgun in my car in Texas for personal safety? Is it an extension of my home?

Kashton, to the best of my understanding the answer is no. You cannot carry a loaded handgun in your car in Texas without the legal protection of a CHL.

Since, you are in CA.

A friend of mine got busted around 10 years ago carrying concealed without a permit. He called me to pick him up from jail.

Orange County SD busted him, hooked & booked with 4 misdemeanors.
Carrying a concealed weapon. Carrying a loaded weapon. Concealed weapon in a vehicle. Loaded weapon in a vehicle. He was 'OR' released after 8 hours in jail.

He plead no contest to 2 of the charges, DA dropped the other 2. Judge fined him $900 and 2 years of probation. His handgun (East German Makarov) was confiscated and destroyed. While he was under probation, he could not own/posses/handle any firearms & ammo and had to sell his Ruger Mini-14.

DO NOT BREAK THE LAW, BY CARRYING A CONCEALED HANDGUN WITHOUT A PERMIT (does not apply in AK or VT).

In CA, carrying without a permit will get you 1-4 misdemeanors. If the handgun is not registered, the misdemeanors just turned into felonies.

Handgun in the car in Texas - it's (generally speaking) okay. They've got a new provision coming into action... September? It's supposed to clarify the 'travelling' provision in Texas law. Some DA - think it's Houston - has been trying to ignore that provision of the law. If you've got a handgun in your car, it's got to be concealed, though.

Long guns, on the other hand, are absolutely and utterly legal in the car - loaded or no, concealed or unconcealed.

No, I can't figure why.

^Quiet, that was a great response, thanks. I've actually been researching the laws on this. What remains murky to me is the concept of concealed weapon in a vehicle. California states that your pistol (long guns are different) must be unloaded and locked in a container; the ammunition must not be in the container; the container cannot be the glove box. I'm trying to think of a scenario in which the pistol locked away as such could be considered concealed carry. Does unloaded automatically make the gun nonconcealed in California?

No.

Also in CA, you can not store a handgun in a vehicle unless you are traveling from one specific location to another. Such as, your home to the range (no side trips or stops are allowed). It is aganist the law to just store a handgun in a vehicle (no handguns for "trunk gun").

However, you can store an unloaded rifle or shotgun in your vehicle (rifle/shotgun is good to go for "trunk gun").

I have known a number of people who carried without a permit. None were ever caught nor did they have need of their firearm. Personally, I don't like the permits. I believe it should be a right without any permission license from the government.

I have in the past.....Ever talked to a few officers about it (not while carring). YES ILLEGAL, but they said unless you do something to cause suspision or look like a gangster they would have no reason to bother you, therefore I would be safe. One of the things everyone needs to remember is the imprint is important. If you carrying IWB but the handle is pushing against your shirt, or you havs a big bulge in you pants the wrong place, it's not really very concealled.

My dad used to carry a S&W revolver in a shoulder holster without a conceled permit. That was ~30 years ago though. I was wondering on a similar note to the texas question, in Denver, how much trouble would you get in for having a loaded handgun in the center consel of your car?

Nope.

My mother was the activity director at an old folk's home. This thread has made me wonder: I expect that if an acquaintance I knew did carry concealed without a permit without my knowledge, it was more likely some old lady than a friend of the same age.

Yeah buddy, I got caught w/ a M36 during a traffic stop in Alabama. (If you got to get caught, be in Alabama). Got a permit before court date, had to pay the traffic fine, but gun was returned, and no CCW charge was dismissed. I Love Alabama!:neener:

Quiet, ok, so here's my situation. I'm in California. I basically can't have a handgun for my car. I basically can't have a CCW because getting a permit is nearly impossible in my county. So, a pistol would be only useful for my nightstand and for the range. For home, I'd rather have a shotgun under the bed or in a closet. For the range or for sport, I'd much rather be shooting shotguns. For the car, a shotgun has fewer restrictions than a handgun. I guess I'm back to square one of two months ago: pros were telling me to get good with a shotgun and not to waste time with pistols in California. I guess legally carrying a handgun for my protection in California has been a figment of my imagination.

The Skipper was arrested by Gilligan for carrying dynamite in his back pocket (a concealed weapon). I don't know what state. I think it was some deserted island.
