fingers seem to be ok now, just hurt like hell. one particulary deeply cut finger hurts during clenching.

will go pick up dog now.

am calling a lawyer today. thanks to a previous poster who recommended several law sites.

owner sent a neighbor busybody over who tried to get me to go talk to the owner at his house. said that "he [the owner] is so emotional.. he's so upset and he's going to cry... the dog is crying too [referring to the rotty!]"

what a load of crock.. he's just afraid ill sue.

this is what happens when you keep a dog locked up in the yard where he gets to run out and bark at people 24hrs, but gets walked only rarely...
 
Damn there's a lot of 'would be' lawyers out here - enough for a good puke for sure. I think he's understands the suggestion - it's only been posted every other time already...:rolleyes:

If this is such a concerning issue, how about this novel approach: start carrying your gun like you should have been doing to begin with. It's known as a 'tool' for a reason...
 
Get a lawyer and sue him, much as I dislike the idea of suing you pretty much need to if you want full compensation and cases like this are one of the lawsuits that really should see our courts. Sue for your bills, your dogs bills, time lost from work, any fees from being out of work like late fees for bills you couldn't pay, and lastly pain and suffering. If there are lasting effects get a doctor/vet to estimate what continued treatment might cost you will probably be able to sue for that as well.

As to what to do with the dog call animal control, even without leash laws a dog that attacks other animals or people is a good candidate to be put down. Dogs fault or not I really don't care, any dog that will attack you and your dog simply for walking down the street is a problem and needs to be put down.

I really hate people that let their animals roam, if you live out in the country on a few acres that's one thing, but when you live in a community you really need to keep your animals inside or at the least a secure fenced in yard (or lacking one of those some kind of chain/rope or run system).

And get yourself a walking stick. They are perfectly legal and are very useful for fending off dogs, also if you make one end sharpened you are now effectively walking around with a weapon that has worked extremely well for many thousands of years, a basic spear. Just don't go crazy and make it extremely obvious it is sharpened, just enough to give you a point sharp enough to break skin with enough force applied.

When fido charges you lower spear and let him use his own momentum to impale himself. Dog hide up front is strong but compared to what some think it isn't chain mail.

stalin (btw he's named stalin because he was so badly f-ed up when i rescued him that he really looked like a monster. i like russian stuff so we named him stalin.. yah i know kim john il would have made more sense.. =P) is also suffering some wierd soft of doggie ptsd. he just stands in th eroom for long periods of time staring at nothing, tail down, not really responsive.

this is horrible.

the other owner called and said "something bad happened between the dogs yesterday... im sorry."

wasn't between the dogs. was between his negligence and my rightful use of the sidewalk.

does anybody here have a CA ccw? can someone give me some pointers? i will carry a cane or something stout from now on, wish i could carry asp but its felony here. i usually carry sabre spray and a knife/951 maglite, but yesterday i lapsed.. and now the result.

i don't know how i could have defended myself from the rott had i been alone though.

damn this all to heck.

re hso: i agree with you totally on many of your points. i should not have held my dog back even for a second and i definitely should have been better prepared.

Let me get this straight: This same dog has attacked you not once, but twice, on the public sidewalk/street, and is still consuming oxygen?

Around here, animal control would have it destroyed as a menace.
 
You really need to manup and kick this dogs ass. I fought three rotts and two sheperds this AM.

Why did you not confront the owner the first time? And leash burn is kinda no big deal, but you did kinda, sorta got hurt. I mean I would not consider that hurt. But you seem upset by it.

I did not catch it was twice. Kinda silly aint it? Do you own a car? A bat, a pair of testes? Your a THR memeber for GODS sake! Run the dog over, Kick the owners ass. Hit the dog with a bat. Call the cops, call Animal control, do something. But twice!

You dont ned a gun to handle this, MAN UP!:banghead:

as for the owner, i'm not content to kick his arse. that would just put me in jail and liability court.

i am howeer going to make him pay.
 
gotta add my 2 cents.....5 seconds after it happened, I would call 911. 1 hour after it happened, I would have an appt. to see a lawyer. This is why we have laws. Anything else will only get you in trouble.
 
Oh man, that poor dog. I hate to see that. Your little buddy did not deserve that. Thanks for the pics though, they really bring it home exactly what happened.

If this happened to me as you describe, (a real dog lover here), this would have been a dead dog. You have a right to protect yourself and to protect yours. Most small dogs that are not life threatening can be dealt with. I've been bit numerous times and yes they are all still alive and functioning normally. I had a Chessie that weighed a 135 lbs., (a big loving baby), that chewed tennis balls for a hour or so a day. There is no doubt in my mind that he could have killed any one at any time if he wanted too. I was at his side when he faced down a Black Bear that probably weighed 350 or so with out any hesitation in the middle of the night when my alarm for the yard went off. The Bear left on friendly terms. He never ran loose unless I was there and he listened. He was friendly and on the beach loved everyone. What's the point of this; dogs can kill and the owners need to recognize this.
If I were you at this point, I'd find the best attorney there was in your state.

yes i agree with you about our loyalty to our dogs - i took my dog to the vet er before even finding a hospital to go to for myself.

this dog was willing to take a bite for me and ive got to go the distance for him too.

Just do something. See I train and own big aggressive dogs. My dogs play together and with other dogs. But All it takes is one bone head to by a backyard rott. And we all get a bad rap.

Also any anger I feel is for little Jindo pup. that sucks. I am beyond a dog lover. Dogs are huge part of my life. Like 40 hours a week. But I would have hurt that dog if I was You. If you do not think you can. Dont try. I have been bittten early in my carreer without a sleave. Big bad pain.

But if you let this guy get away with this, he might kill somebodys pet or worse.

i am working a rott right now today. that killed a dog. we muzzle that dog, put a pinch coller on him and let dogs crawl all over him. when he reacts, we choke the crap out of him. Repeat as needed.

But you must do something. Nuff said. I mean no desrespect. I just have a harsh sense of whats funny. Stevo...........
 
You might try calling your local BAR Association for suggested lawyers. There is also the Yellow Pages, the attorneys often list their specialties, and then there is the Internet.

Yes his statement about his dog crying is ass-kissing, I kissed up much more than should be allowed even though the "victim" had taunted my dog and opened my gate

Call a lawyer, any lawyer, watch TV for one the shysters that are always advertising.It's a dog bite case not a murder case a first year law student could win it.
Your lawyer will set the price and request his insurance information. Unless he owns his home outright he has HO insurance, who will promptly drop him.
Even if he does not have a dog endorsement he has medical liability insurance that will probably pay the actual damages.
If he wants to keep his insurance and not have to go shopping for another company at half again the price he will get rid of the dog.

That along with the ex-lax trick should take care of the menace.

If the thing has attacked two people already then by god its a freaking dog put a bullet in it... if that dog would have attacked that mans kids i garantee you he would have taken action... california needs to get their head out their butts and make thier citizens not so freaking defensless. In Texas that dog would have had some 000 buck down his throat by now. Im a dog lover and trainer but dogs like that jsut need to be put down. Take some pepper spray with you and it tries that trick again give it the whole can!!!!

I dunno about this, in some states this is a felony, unless you imform the person on the other end of the phone that the conversation is being recorded. Anyone remember Linda Tripp?
 
Police report, lawyer. There is criminal negligence on the other dogs owner. The dog needs to be taken from him and destroyed. Not just the dogs fault but a dangerous dog needs to be put down.

In some areas it is illegal to audio tape someone without their permission
 
I feel you have an obligation to call the police. You have an unrestrained dog thats attacking without provacation. When my son walks our dog I'm about an arms length away with a gun on my hip, but I see several of my neighborhood kids out and about without parental supervision and some of them are walking dogs. Dog gets tired of attacking dogs, attacks child walking dog because child is easier target, you knew dog attacked before it attacked the child and did nothing to stop its attacking therefore YOU allowed the dog to attack the child. Knowledge is power, power is responsibility.
 
Call a lawyer and animal control before any more time passes. In my town the dog would be confiscated and destroyed. I will never understand why dog owners do not leash their dogs 100% when outside a confined area i.e. fenced in yard. I do it not just for the safety and well being of others but also for the safety of my pets.

Well, the best place to find them is under rocks or in a slime covered pool. If you see an ambulance, follow it and there will be lawyers crawling out from the sewer to chase it.

But, all kidding aside, it would be best to sic <pun intended> a Lawyer on this dude. Get police reports, get as many photos as possible and make it known to the law that this is a problem dog.

I feel bad for you and your dog and am sorry for your injuries, but you're really incapacitated due to rope burns? I don't know. A lawsuit over something like this leaves a bad taste in my mouth. Especially here at THR.

Edited to add: By all means, call Animal Control, report it to the police, make sure others aren't subjected to this mutt's temper, and good luck to you.
 
Personally, I think this society is a little too quick to whip pet lawyers out of their holsters for what is otherwise a normal neighbor issue. Once lawyers come out to play, you've pretty much zero chance of any civil interaction with that person ever again.

Have a chat.

Mention your desire to handle it in a quiet, friendly, neighborly manner, seeing as y'all have to live 100 yards from each other.

Show a pic, and a copy of the med bill. (redact for privacy)

Also mention the consequences of police report, local animal laws, and the impact on insurance.

Also make it clear that you expect the rott to be fully controled and maintained @ all times.


Then, it's his move.

He can man up and do the right thing, or not, but it'll be his karma, not yours.
 
First thing that came to my mind as I read post #1: Why in the heck would you walk by the home of a unleashed rott that previously attacked you, especially if you're unarmed (no spray, no pointy stick, nothing!).

I can’t think of a good answer to this question.

Your situation is horrible, especially for your poor pup -- those wounds look mighty uncomfortable... but why not walk down another block at least until this neighbor was confronted with positive results???

Idyllically, you should be able to walk in your neighborhood w/out fear of attack. But realistically, your neighborhood is not set up that way because this irresponsible dog owner has remained unchallenged by any of his neighbors – or at least unchallenged with results. Anyone who owns a child in that 'hood should take particular issue with your situation.

The worst part is the dog probably got a real good beating that was more deserving of it’s owner.

Did you contact the police after the first attack so that this can be documented as the second attack?

I pray for you and your pooch to heal well and make a full recovery.

PS -- someone made a comment regarding the type of leash you use, take that advice and get a standard leash.
