Colorado Gun Control - Standard Capacity Magazines, Private Sales proposed bans

We are fighting a battle for our national soul, and attaching firearms to a political slant or particular demographic is short-sighted and WE WILL LOSE. Firearms are not beloved by all Republicans, nor hated by all Democrats, and the same goes with the poorly applied "liberal" and "conservative" labels. Further, using them tends to alienate the curious who are here to learn. Let's help them learn that some gun owners are accepting of all law-abiding potential gun owners, regardless of where they sit on the political spectrum.

Due process of diligence in politics is similar to due process of law. Due process of law applies the law on a case by case basis to individuals who are tried on the basis of their personal actions, not their membership in, or perceived affiliation with, any group. Generally, prosecution or legislation against anyone because a perceived or real group association is a denial of due process of law.

In politics, it is easy to group politicians by their party affiliation and while this is helpful to some extent, is can be hurtful as many political candidates hide their true beliefs behind a party label. if your attention does not extend to the individual candidate's political statements and actions, you have denied that candidate (and yourself) due process of diligence.

Due diligence takes extra effort. Straight party voting is the lazy way out.

Pilot: The CO HB 1224 being sent to the Governor bans ANY magazine that can be modified. For example, this includes nearly all AR and Glock magazines. Most rifle and handgun magazines are made so they are able to be extended.

But existing mags are grandfathered for those that possess them.

Not exactly. Any magazine that can accept an extension to more than 15 rounds would allegedly be a "high capacity ammunition feeding device" but those that are pre-ban are still pre-ban.

Derek, I am neither pro-republican or pro-Democrat... I dislike them evenly for different reasons. As I yet I have never met a conservative that is against the 2nd amendment, and have rarely met a liberal that supports it. That is my experience in life. I am pro-constitution in terms of it's original intent, and 99% of politicians are quite the opposite.

By some folks' definition some to most of THR's staff are liberals. (More properly, libertarian in ideals, but an unwillingness to tamper with people's sex lives, religious life or lack thereof, and the recreational substances they ingest = "liberal" in quite a few minds. Some of them members here.)

Not a legal expert, but wouldn't the exemptions in the CO legislation that exempts current and former LEO (and others) from things like the mag ban go against the 14th amendments equal protection clause?

How are any of these laws constitutional under the state constitution? It doesn't say anything about arms approved by the legislature.

Text of Section 13:

Right to Bear Arms

The right of no person to keep and bear arms in defense of his home, person and property, or in aid of the civil power when thereto legally summoned, shall be called in question; but nothing herein contained shall be construed to justify the practice of carrying concealed weapons.

Glad our family vacationed in Colorado this summer, cause we won't be back. Not that it will make a bit of difference to those running the asylum.

The Arbuckle Mtns are just as majestic as the Rockies! Right?

I live less than 15 miles from the CO border, and love to ride the SW CO scenic loop, but no more. I refuse to spend my limited discretionary income in a state that does not respect my rights. my gasoline dollars will go to NM,AZ, and UT, and if I get the chance TX and OK.

My plan is to send as much cash to pro 2nd amendment candidates in 2014 as I can afford. I'll also use my gps to avoid blue counties when I travel.

I sure hope you guys are telling Hickenlooper about how you won't be spending your vaca's in Colorado if he signs this farce.

Here is an interesting discussion of conservative, liberal, libertarian labels.

Understanding THR does not wish to engage in political discussions, I must question how can that be avoided when looking at the gun control holocaust we are facing? Political philosophy is at the heart of this discussion no matter how much some may wish to avoid that obvious conclusion and the obvious discussion.

As a "conservative, right wing Christian," in the end, I believe much of what the founding fathers believed about our freedom and liberty yet many call them "classical liberals." These "classical liberals" are quite different from modern liberals in that their intent was to limit the powers of government and expand individual freedoms. Many would call them "libertarians" today, yet one clear difference is noted.

These men publicly attributed our rights to God which were called natural rights whether or not their private views differed. That is my belief as well that our rights our from God. Many called libertarian today do not. That is a specific difference between many of the writings of today's libertarians from those of our founding father's who are often called libertarian.

Indeed, JShirley, today, we have many conservatives, liberals, centrists, libertarians who all agree on that one point, they all have rejected the concept of God as the source of our rights.

Even if we can bring together a coalition of conservative, liberal, and libertarian gun owners, will that prevent the loss of rights which I believe are derived from God alone? It is my belief that it will not since I believe God is indeed real.

In Colorado, it appears that electing state legislators on the libertarian ideals of expanding individual liberty of decriminalizing marijuana helped bring in a Democratic majority on a topic opposed by conservative Republicans. Will that then allow the Democrats to usurp power paradoxically from those seeking more liberty? It appears in my opinion that is exactly what is happening. Political philosophy does matter and does have consequences. I would hope we would be allowed to discuss that openly on THR.

If not, then I have enjoyed my time here and will simply have to move on.

God bless,

Alaska

I don't know if the courts would rule that issue of prohibited items to serving law enforcement violates the 14th Amendment.

Retired LEOs would be a whole other issue, and might be a point the legislation could get hammered on.

And this harms the movement how?

I would be most happy to answer your question in detail through a pm if you wish, but THR does not allow indepth religious discussions. With gun control, political discussions are unavoidable. In brief, do you bless those that reject you? God does not either.

Reality is an illusion, and existence is fleeting.
Why should I be bothered that others reject me?
I have better things to do than be ensared in a web of hatred and anger.

I honestly cannot say whether religion harms or helps the movement, but, to quote Jefferson, “It does me no injury for my neighbor to say there are 20 gods, or no god. It neither picks my pocket nor breaks my leg.”
